由于长期以来我国个人破产制度的缺失，一些民事执行措施在自然人债务清理方面发挥着巨大的替代作用。然而，无论是参与分配制度，还是针对被执行人的限制和惩戒制度，相较于个人破产制度而言都存在着许多不足，无法真正取代个人破产制度。近年来，一些地区法院也在民事执行中进行了如个人债务集中清理程序等尝试和创新，但仍存在着明显的缺陷，无法与真正的个人破产制度相提并论。因此，为了更完备地解决我国自然人债务清理实践中出现的种种问题，将建立个人破产制度提上议程已经刻不容缓。与此同时，应注重构建民事执行制度与个人破产制度之间的衔接，更好地促进两项司法制度分工协作、相互配合，保障自然人债务清理问题的有效解决，促进经济与社会发展。

However, compared with the personal bankruptcy system, there are many deficiencies in both the participation in distribution system and the restriction and punishment system for the debtor, which can’t really replace the personal bankruptcy system. In recent years, some district courts have also tried to innovate the civil enforcement, such as the centralized liquidation procedure of personal debts. But it is still unable to compare with the real personal bankruptcy system. It is indispensable to build the personal bankruptcy system in China to solve the problem of debt liquidation of natural persons. At the same time, we should pay attention to the connection between the civil execution system and the personal bankruptcy system, to encourage the cooperation between the two judicial systems, solve the problem of debt liquidation of natural persons effectively, and promote economic and social development.
