城市房屋拆迁听证制度是城市房屋拆迁法律制度在发展过程中，将行政听证制度引入城市房屋拆迁程序所产生的制度，它是城市房屋拆迁程序中体现正当程序、保障人权、民主政治的重要制度。 城市房屋拆迁听证制度的设定和实施对于保护公民、法人和其他组织的合法权益，保障和监督行政机关有效实施行政管理具有重要意义。但是，由于行政听证制度在我国起步较晚，受传统管理模式的影响，再加上我国还没有制定统一的行政程序法典，对行政听证的各项制度没有统一、全面的规定，因此城市房屋拆迁听证制度这个在具体实施领域产生的新事物还有一些需要完善的地方。 为了能清晰、明确地分析论证和完善城市房屋拆迁听证制度存在的问题，笔者在本文中分三部分进行了论述： 第一部分，城市房屋拆迁听证制度的一般理论。这部分从目前学界的观点出发，综合论述了城市房屋拆迁和听证的概念、城市房屋拆迁引入听证制度的重大意义、城市房屋拆迁听证制度的基本原则。 第二部分，城市房屋拆迁中听证程序的现状及其存在的主要问题。这部分从城市房屋拆迁听证制度的一般理论出发，结合现行城市房屋拆迁相关的法规规章及地方性法规规章，针对城市房屋拆迁听证制度的规定及各种制度，从城市房屋拆迁听证的适用范围、听证参加人制度、听证前程序、听证证据制度、听证中特殊情况制度、听证监督和责任制度六个重要方面入手，包括对拆迁许可听证制度、行政裁决前听证制度、强制拆迁前听证制度、听证主持人制度、回避制度、启动模式、告知制度、听证笔录制度等进行深入分析，提出现行的各种制度中存在的问题和这些问题对城市房屋拆迁听证制度的不利影响。 第三部分，完善城市房屋拆迁听证程序的构想。这部分是针对在文章第二部分中分析城市房屋拆迁听证制度的六个重要方面及各种制度所提出的主要问题，结合国内外听证制度的发展以及我国城市房屋拆迁听证制度的实际情况，有针对性地提出了一些相对具有建设性的修改和完善城市房屋拆迁听证制度的意见。

It comprehensively discusses the concepts of urban housing demolition and hearing, the great significance of introducing hearing system for urban housing demolition process and the basic principles of urban housing demolition hearing system. Part two, Present Status and Major Problems Existing in Urban Housing Demolition Hearing Procedure. Based on the general theory of urban housing demolition hearing system, combining with existing urban housing demolition regulations and rules and the local regulations and rules, aiming at the regulations and various systems in the urban housing demolition system, and starting with six important aspects concerning range of Application of Urban Housing Demolition Hearing, Participants in the Hearing System, Pre-hearing Procedure, Hearing Evidence System, Hearing Particular Case System, Hearing Supervision and Responsibility System, including conducting in-depth analysis to Demolition Permit Hearing System, Pre-administrative Judgment Hearing System, Pre-forced Demolition Hearing System, Hearing Moderator System, Challenge System, Motivation Pattern, Notification System and Hearing Record System, etc., this part presents existing problems in various current systems and their adverse effects on urban housing demolition hearing system. Part three, Complete the Urban Housing Demolition Hearing Procedure Conception. Aiming at the six important aspects of the urban housing demolition hearing system analyzed in Part two of this article and significant problems presented from various systems, and combining actual conditions of home and abroad hearing system development as well as the urban housing demolition hearing system in China, this part presents some relatively constructive modification and completion suggestions for the urban housing demolition hearing system.
