举世瞩目的改革开放,使我国迎来了发展经济、改善民生的黄金时代,经济、政治、社会等方方面面都呈现出一派繁荣景象。然而每个硬币都有两面,问题和发展总是相伴相生的。其中一个相当突出的问题就是经济犯罪数量不断飙升,对社会的危害日趋严重。对此我国历来绝不松懈,坚决严厉打击。根据现行的刑罚制度,绝大多数经济犯罪都配置了自由刑,可以说,自由刑居于核心地位,同时打击经济犯罪也离不开生命刑和财产刑等刑罚方法的辅助。这种体系是有效的,但是弊端也很明显,那就是基本难寻资格刑的踪影。而在司法实践中,针对经济犯罪主要是判处有期徒刑,这就导致现有的资格刑基本上无法适用于经济犯罪。在单位经济犯罪方面,资格刑更是完全空白。可见我国经济犯罪资格刑非常单薄,而且罪行不相适应。有必要反思资格刑在刑罚体系中的地位和意义,充分发挥其在打击经济犯罪中的作用。可喜的是,越来越多的学者和实务工作者开始潜心研究经济犯罪的特征及规律,为经济犯罪配置有针对性的资格刑。本文借鉴学习,从以下五个角度进行探究和分析,以期能有助于我国经济犯罪资格刑的完善和发展。本文首先分别对经济犯罪和资格刑的概念及特征进行分析,通过比较对照,初步认定资格刑理所当然应被用来惩罚和预防经济犯罪,并且这种作用是无法替代的。其次,介绍我国经济犯罪资格刑的立法现状,分析我国现行经济犯罪立法中资格刑种类单一,且不具有针对性的弊端。再次,笔者从遏制经济犯罪、完善刑罚体系、顺应发展趋势三方面论证了完善我国经济犯罪资格刑的价值。接着,介绍国外关于经济犯罪资格刑的规定以及我国相关的以剥夺资格为内容的行政措施,为完善工作提供立法借鉴。最后,从资格刑本身的种类体系和适用制度两方面谈有关完善我国经济犯罪资格刑的构想。我国经济犯罪资格刑的完善工作是一个系统工程,本文首先明确资格刑作为附加刑的法律地位,进而根据适用对象的不同,针对自然人和单位分别设置不同种类的刑罚。具体来说,针对自然人,在改造现有资格刑的同时,增设两种新型资格刑。对单位,则全面创设三种全新的资格刑。在适用制度方面,笔者建议构建资格刑减刑及资格恢复等配套制度,使我国经济犯罪资格刑不仅种类丰富,而且适用合理,从而形成一个完整统一的整体。

Since China take the reform and open up till now, we have achieved much in economy .However, with China’s economy thriving, large number of economic crime occurs, which has seriously affected China's political, economic and social stability. The free punishment forms the nucleus of the existing economic crime penalty system of China. At the same time, the death penalty and the property punishment are extensively used. There are evident defect and flaw in this kind of system of punishment as to economic crime. One kind of efficient punishment is the qualification penalty, however, it is seldom utilized in reality. The article principally analyzes how to improve the qualification penalty for economic crime in five factors. Firstly, I brief the concept of the economic crime together with the characteristic of the qualification penalty. Secondly, I describe the existing status of legislation of China. Thirdly, I analyze the urgent need of improving the qualification penalty for economic crime. Fourthly, I introduce the status of legislation of abroad and the relevant provisions of the legal regulations. Lastly, I make my suggestion from two aspects.The one is how to establish the system of penalty qualification itself; the other is the supporting measures related to running the system. Firstly, while both natural persons and legal persons can undertake economic crime, on the basis of the subjects, we can include them into different system. On the one hand, the penalty qualification to natural persons contains: the deprivation of political rights; prohibit from acting as specific duties; forbid engaging in particular professions; deportation. On the other hand, there are three kind of penalty qualification towards the legal persons, which are stopping doing business for internal rectification; prohibiting units undertaking specific business activities; involuntary dissolution. In addition, when considering the supporting measures, we suggest that the commutation system and the rights recovery system should be established. In conclusion, we should make the qualification penalty for economic crime a unified system.
