凶宅是指在专有部分发生过人为致人死亡事件的房屋，具体界定要予以严格限制，同时引入凶宅的消除因素，具备消除因素时凶宅可恢复正常。凶宅禁忌应属于封建迷信。当事人之间有凶宅相关约定时，出卖人基于约定负有披露义务。当事人之间未对凶宅进行相关约定时，基于凶宅禁忌属于封建迷信、披露凶宅导致巨大的效率成本、凶宅不构成物的瑕疵以及出卖人隐私保护的考量，出卖人可不披露凶宅信息。处理凶宅买卖纠纷问题应平衡当事人双方的权利义务，加强对出卖人的利益保护。
