在当今国际社会，对于敏感个人信息的特别保护已然成为立法的主流方向。这种将敏感个人信息与一般个人信息区分对待的做法，主要源于敏感个人信息本身所承载的更高的法律保护需求。并且在大数据时代，为了缓解知情同意原则适用僵硬的困境，实现对个人信息和数据合理利用的动态平衡，需要对敏感信息和一般信息采取宽严相济的保护方式。同时根据《个人信息保护法》第28条，可以将敏感个人信息的判断标准分为内容敏感型和主体敏感型，内容敏感型主要指人格尊严标准和人身、财产安全标准，主体敏感型标准则指年龄标准。《民法典》中的私密信息与敏感个人信息应为交叉重合的关系，二者既在内涵、信息公开性、人格权属性等方面存在差异，但又有所联系。我国《个人信息保护法》与国际趋势接轨，实施敏感信息分类保护策略，有利于平衡个人信息保护与合理利用。

Recently, the augmentation of safeguarding sensitive personal information has surfaced as a dominant trend within global legislative frameworks. The core reason for defining sensitive personal information lies in the heightened sensitivity of the former towards legal regulation. Moreover, in the era of big data, in order to alleviate the dilemma of rigid application of the principle of informed consent and to achieve a dynamic balance between the reasonable use of personal information and data, it is necessary to adopt a lenient and stringent approach to the protection of sensitive information and general information. According to Article 28 of the Personal Information Protection Act, the criteria for judging sensitive personal information can be divided into content-based and subject-based sensitivity, with content-based sensitivity referring mainly to the criteria of human dignity and the security of persons and property, and subject-based criteria referring to the age criterion. The relationship between private information and sensitive personal information in the Civil Code should be cross-cutting and overlapping, with the two differing in terms of connotation, information disclosure, and attributes of the right to personality, but also being related. China's Personal Information Protection Law is in line with international trends and implements a strategy of classifying and protecting sensitive information, which is conducive to balancing the protection of personal information with its rational use.
