近年来我国生态环境损害赔偿制度有了初步的规范，为现实中的个案处理提供了理论依据，但由于具体细节规定不到位也产生了很多问题，例如对 损害赔偿的范围和赔偿资金的后续使用管理不明确、与环境民事公益诉讼制度的衔接整合不完善等。通过对我国现有规则的梳理以及发展现状的剖析， 能够更加了解生态环境损害赔偿制度，并结合具体案例重点说明，既要看到听取专家意见、结合被告实际经济情况、将损害赔偿诉讼与民事公益诉讼有效衔接等进步意义，也要指出评估体系、磋商体系不完备，资金管理不够细化等不足，据此探讨今后生态环境损害赔偿制度的发展趋势，并尝试性地提出一些有关评估程序、生态救济体系整合、赔偿资金管理方面的改善建议， 从而使生态环境损害赔偿制度更加完善，使之满足实际需要，真正推动相关法律体系建设及生态环境保护。

In recent years, our environmental damage compensation system is developing rapidly, and provides theoretical basis for the real case. However, some specific details does not reach the designated position. It produces many problems, such as the scope of damages compensation, the management of compensation funds, the linkage between the environmental civil public interest litigation system integration and the environmental damage compensation. Through the analysis of the development status of China's environmental damage compensation system,and the combination of specific cases to illustrate,we should not only see the progressive significance of listening to experts' opinions, combining the actual economic situation of the defendant, and effectively linking the damage compensation litigation with the civil public interest litigation, but also point out that the evaluation system and consultation system are not complete, and the fund management is not detailed enough. We discuss the development trend of the compensation system for environmental damage here, provide some suggestions on the improvement of evaluation procedure, integration of ecological relief system and compensation fund management, to make the environmental damage compensation system more perfect, more realistic,truly promote the construction of relevant legal systems and the protection of the ecological environment.
