我国长期实行高耗水、高耗能、高污染的粗放式发展模式，在经济高速发展的同时付出了高昂的环境代价。近年来，我国相继出台了一系列的政策法规来改善发展模式、调整经济结构、减少污染排放、提高环境质量。在我国当前法制制度不健全，尤其是公益诉讼制度严重缺失，社会的自治水平较低的情况下，环境信访制度作为解决环境纠纷的非诉讼方式中的行政处理方式，是解决我国环境纠纷的最主要方式，是环境管理体系的重要一环，可以直观地反映该地区的整体环境管理现状和环境质量。 本论文选定丰台区为研究区域，依托多年的统计数据及典型性案例为基础进行研究。环境信访总量从2004年逐年攀升，2008年达到最高峰，之后逐渐回落，2013年有所回升。每年2月份案件最少，8月份最多，问题主要集中在大气污染、噪声污染两方面，以电话来访为主，目的主要是请求处理环境纠纷。 环境信访工作主要存在五方面问题。一是总量大，人员不足。二是个别问题长期得不到解决。三是居民住宅区案件多。四是重复访、多投访、乱投访问题严重。五是涉及经济纠纷、借题发挥的信访案件增多。 环境信访案件主要有四个成因。一是发展过快，规划、建设布局不合理，发展不平衡，基础设施建设滞后，且流动人口量大，管理难度大。二是法律不健全、政策存在漏洞，处罚力度过轻。三是地方政府重视不够，环保部门受地方、军队制约过多，部门联动机制留于形式，环保部门自身力量不足，政府部门环境管理不善，相应的监管、考核制度也不合理。四是公民自制意识不足，社会整体环保意识欠缺。 针对以上现状、存在的问题及成因，首先建议全国和北京市都要合理规划，协调发展。其次要完善法规制度，赋予环保部门履职所必要的职权，同时适当的提高污染物排放收费标准和环境违法处罚额度。再次要充分利用自身资源，优化资源配置，规范工作流程，加强自身能力建设，提高环境信访处理效率。另外要改善管理机制，避免地方和军队制约，同时强化责任意识，加强部门联动，转换考核方式，提高监管能力，提高环境管理能力。最后要提高公民自制能力和自治意识，强化社区自制能力，发展社会公益组织，形成社会合力。

A high environmental price is paid from the rapid development of the economy. In recent years, Our country has successively promulgated a series of policies, rules and regulations not only to improve the development mode, but also to adjust the economic structure, in order to reduce pollution emissions, and to improve environmental quality. Our current legal system is not perfect enough, especially the lack of public interest litigation system, the level of social autonomy is too low. And the environmental petition system, as the administrative processing of the non-litigation system to solve the environmental dispute in the way, is the main party to resolve environmental disputes in China, which is very important for the environmental management system, that can directly reflect the region's overall situation of environmental management and environmental quality. Fengtai District was selected as the study area in this paper, primarily based on the statistical data for many years and the typical cases research. The total number of environmental petition from 2004 had been increasing year by year, in 2008 reached a peak, then gradually decline, rebounded in 2013. Environmental petition in February each year the fewest amount and in August the largest amount. The cases mainly focus on two aspects including air pollution and noise pollution. Environmental petition mainly by the phone calls. The main purpose is to request processing environmental disputes. There are five outstanding problems about the environmental petition work. Firstly, the total quantity is big with the lack of staff. Secondly, the individual problems are remain unresolved for a long time. Thirdly, the residential cases concentrated. Fourthly, is the large number of repeat petition, repeatedly petition and error petition. The last but not the least is the increase of cases of involved in financial disputes and noise. There are four main reasons for the environmental petition cases. One is the rapid development, planning, construction layout not reasonable, development not balanced, the lag of infrastructure, and large amount of floating population, the management difficulty so big. Two is the law is not perfect, the policy loopholes, the punishment too light. The three is the local government does not pay enough attention to the environmental protection, the environmental protection department under too many constraints from local and army forces, the departments linkage mechanism to stay in form, the environmental protection department's own lack of strength, the environmental management contain loopholes，the corresponding supervision, evaluation system is not reasonable. Four is lacking of self-consciousness of citizens, the whole social environmental protection consciousness lack. For these current situations above, the existing problems and the cause of formation, Firstly, I suggest that the national and Beijing city have to rational planning, coordinated development. Secondly, I propose to improve the legal system, the necessity to give the environmental protection department performance functions, the appropriate increase of pollutants emission standards and environmental illegal punishment amount. Thirdly, we must to utilize one's own resources fully，optimize the allocation of resources, standardize the work flow, strengthen the ability construction, so as to improve the efficiency of environmental petition processing. Fourthly, we must to improve the management mechanism, avoid local and military control, and strengthen the sense of responsibility, strengthen the sector linkage, conversion assessment methods, improving the supervision ability, so as to improve the environmental management capacity. Finally, it is important to improve the ability of self-control and self-consciousness of citizens, strengthen community self-control ability, the development of social welfare organizations, a force form in the range of the whole society.
