程序正义理念践之于我国的公共政策制定，至今已有近二十年的历史。这一理念对于保障公共政策制定和实施的质量发挥了重要作用。通过总结中国公共政策过程中该理念的应用现状，在肯定成绩的同时，明确应用中表面化、片面化和机械化现象的症结所在，进一步审视程序的独立内在价值，将程序问题与公正性结合起来考虑，强化程序正义理念所必须的参与性、中立性、合理性、对等性、自治性和及时终结性的应用，在根源上排除公共政策制定过程中的恣意，使公共政策的产生保持理性。通过完善社会治理结构、完善程序法律体系，责任制度规范化和构建依法行政的评价体系等途径，把公共政策制定的重点转移到确立给予政策变更的选择方式上来，建立一个可变而又可控的公共政策再生产的有机结构（constitution）。最终将行政决策者从解决局部问题的忙碌中解脱出来，利用客观、公正的公共政策去规范各个社会主体的行为，成功应对转型时期复杂国内外形势的挑战，实现各种社会关系的良性运转，最终促进社会主义民主政治的发展和公共决策的科学化、民主化、法制化。

The theory of procedural justice has been applied in the establishment of Chinese public policies for nearly two decades. The concept is crucial for the quality of establishment and implementation of public policies.While analyzing the present application of procedural justice in public policy making and implementation, we should acknowledge the success, and at the same time, find out the fundamental causes of superficiality and unilateralism as well as mechanism. We must further recognize the inherent value of procedure and combine it with justice. More emphasis should be put on the theory’s nature of being participative, independent, rational, equitable, autonomic and promptly terminative. We should eliminate arbitrariness to ensure that public policies are rational. By improving social pattern and legal system, standardizing liability system, and establishing an assessment system based on lawful governing, we should shift the focus of public policies making to seeking effective ways of properly amending public policies, and set up a flexible but controllable constitution for the reproduction of public policies. This could release administrative leaders from solving individual problems so they can regulate the actions of all parts of this society via objective and equitable public policies. This can also help leaders successfully deal with complicated internal and external challenges during the transformation period, improve social relations, and promote the development of a socialist democracy and scientific, democratic and legal public policies.
