2011年初，深圳市开展的“治安高危人员排查清理百日行动”引发了很大的争议。本文选择从刑事政策角度，对这行动进行分析。本文正文内容共分四章。第一章为问题的提出。“清理政策”作为一项刑事政策，其出台由一系列现实条件促成的。举办大运会是促成这一政策的直接动因，外来人员犯罪突出是制定这一政策的“经验依据”，而“特区政策”下的“创新冲动”则是这一争议性政策的重要推手。这一政策具有相当的必然性、也具有一定合理性、注定会引发广泛争议。第二章是从价值理论层面对深圳这一刑事政策进行分析。作为刑事政策价值的自由、秩序、公正、效率是有层次性和体系性的，秩序和效率应当是手段性的价值目标，自由和公正才是最终的价值目标。深圳此次“清理政策”引发争议主要原因也就是对手段性的价值目标追求过度，而对最终的价值目标追求不足，不符合人们对刑事政策的期望。第三章是从刑事政策模式的角度对这一刑事政策进行分析。在我国当今社会条件下刑事政策应当由国家本位型转变为国家社会双本位型，而深圳“清理政策”选择了加强国家本位模式，而没有选择向国家社会双本位模式转变。“清理政策”引发的争议也反映了国家本位型的“清理政策”已经不能完全适合深圳社会的需求，需要进行改进。第四章是从抽象和具象两个层面对深圳刑事政策的改进提出建议。抽象观念层面转变包括：转变价值主体的观念，理顺价值目标之间的关系，转变刑事政策模式；具象实践方面的转变包括：防止具体政策随意突破法律，在探求犯罪发生原因的基础上科学地解决犯罪问题，并且为刑事政策注入更为丰富的人道主义内涵。

In early 2011, Shenzhen City, in order to ensure the successful convocation of the 26th World University Games, carried out "The One Hundred Days Action of Investigating and Expelling the Potentially Unstable People". This action caused considerable controversy. In this paper, the author, in order to analyze the action, chose from the perspective of Criminal Policy . This paper is divided into four parts. The first chapter is the analysis of the facts. Shenzhen City’s "Clean-up policy" is a local and temporary criminal policy, and has quite the inevitability and certain rationality, destined to lead to widespread controversy. The “clean-up policy” basis in realty of Shenzhen City’s social security status; hosting of he 26th World University Games was the direct motive to promote the “clean-up policy”; highlight the crime of foreign personnel is the “empirical evidence” of the policy, and, the “Special administrative region complex innovation impulses” of Government is a major force behind this policy.The second chapter is the analysis from the theory of value level of the criminal policy o. As a criminal policy of the value of freedom, order, fairness and efficiency is a multi-level of system, freedom and efficiency should be the means of the value target, freedom and fairness is the ultimate value targets. The main reason why Shenzhen City’s “clean-up policy” caused controversy is the means of the value of objective pursuit of excessive, and the pursuit of the ultimate value of the target.The third chapter is the analysis of this policy from the perspective of Criminal Policy Pattern. Transformation trend of Criminal policy in the social conditions today should be by the transformation of the national-based standard for the dual-based standard, while ShenzhenCity’s “clean up policy” excessive strengthening the national standard mode, rather than an alternative to the dual-based model of the national social changes. The controversy caused by the “clean-up policy” also reflects the State Standard Type" clean-up policy "has not entirely suitable for the needs of the community in Shenzhen, need to be improved.The fourth chapter is the recommendation of the Shenzhen city’s criminal policy from the two abstract on the improvement. From the aspect of abstraction, it is necessary to changes the value of the main concept and rationalize the relation between the values of the target .From the aspect of practical ,it is necessary to prevent the policy arbitrarily breaking law and scientific to solve the crime problem and further enrich the humanitarian dimension of the criminal policy.
