为了贯彻中央关于“房子是用来住的,不是用来炒的”定位,落实《北京城市总体规划(2016年-2035年)》中“增加共有产权住房与中小套型普通商品住房供应”的要求,北京市于2017年9月20日印发《北京市共有产权住房管理暂行办法》(京建法〔2017〕16号文)。并于22日发布《北京市共有产权住房规划设计宜居建设导则(试行)》(京建法〔2017〕20号文)。2018年7月,北京房地产估价师和土地估价师与不动产登记代理人协会发布《北京市共有产权住房价格评估技术指引(试行)》(北估秘〔2018〕012号)。上述这些,标志着北京市共有产权住房政策逐步落地实施。 北京市共有产权住房的发展,既是时代背景下保障居民居住权利的必然结果,也是首都发展客观规律的要求。因此,北京市共有产权住房的发展具有普遍性,也具有特殊性。 本文在广泛研究相关文献基础上,对国内外共有产权住房政策的实施现状和运行模式进行分析研究,可以看出目前共有产权住房政策对发展中存在的问题和表现研究的较多,对解决措施和途径研究未尽详实。笔者运用案例分析法和调查法对北京市共有产权住房政策的执行情况从政策产出阶段、立项阶段、申购阶段和后续管理阶段等四个阶段进行了全面梳理,并联系政策执行的不同阶段来考察各个变量对政策执行的影响进行分析,得出北京市共有产权住房政策存在执行细则不到位、供地区域不平衡、申购条件较严格、后续管理不完善等四个问题,运用萨巴蒂尔和马兹曼尼安政策执行综合模型对问题进行分析,基于综合模型中的3个方面17个要素,结合实际情况和问题选取对应要素,从政策有效执行、政策本身的规制能力和政策本身以外的变量进行原因分析,在坚持以人为本、公平高效、政府与市场相结合的原则基础上,从细化制度简化标准、完善价格评估体系、平衡土地供应区域、提高建筑品质、健全法律保障体系、加强监督管理等六个方面提出北京市共有产权住房政策的完善路径。 |

In order to implement the central government’s policy about "Houses are for living in and not for speculative investment ", Beijing government issued many principles and polices for shared ownership housing from 2017 till now. These, marking Beijing shared ownership housing policy to be put into practice step by step. The development of shared ownership housing in Beijing has both universality and particularity. It is not only the inevitable result of protecting residents' right for living but also the requirement of objective law of the development of Beijing. Based on extensive research on relevant literature, this paper analyzes and studies the implementation status and operation mode of housing policies with common property right domestic and overseas. It can be seen that there are many studies on the problems and performance of housing policies with shared ownership housing on development, but the research on solutions and approaches is not fully detailed. The author uses method of case analysis and investigation of Beijing's housing policy implementation of property from a policy of four stages, such as output, project, purchase and subsequent management phase. It is concluded that Beijing shared ownership housing policy implementation rules don't reach the designated position. Through Sabatier and Mazmanian integrated model of policy implementation, this paper analyzes problems based on the three aspects of the comprehensive model of 17 elements. Combined with the actual situation and problems of selecting corresponding elements, from the policy effective execution, based on the principle of people-oriented, fair and efficient, the article concludes six aspects to be improved for Beijing shared ownership housing policy such as simplified standard, perfect price evaluation system, balance the supply of land area, improving the construction quality, improve the legal protection system and strengthen supervision and management. |
