This article analyzes cases of climate change litigation based on human rights, and summarizes the multidimensional impact of regional human rights courts on human rights in climate change litigation, as well as the non-litigation remedies provided by the United Nations system for human rights violations caused by climate change. Through empirical research, the article summarizes the application of major human rights laws in climate change litigation in various countries. The article also explains the difficulties in linking human rights and the environment in both procedural and substantive aspects of litigation. Overall, human rights-based climate change litigation still faces dual barriers of theory and practice, but it demonstrates strong vitality and high plasticity, and has the potential to promote social and policy change. Against the backdrop of the United Nations system encouraging and recognizing the substantive connection between climate change and human rights, China should consider incorporating human rights factors into its climate and environmental governance system. |
