随着人工智能技术的发展，致命性自主武器系统为作战力量的革新提供了新的进路，但同时也对传统战争法规与惯例造成了一定的冲击。科技赋予了致命性自主武器系统一定的自主能力，使其可以在没有人类干预的情况下完成从搜索目标至实施打击的一系列动作。致命性自主武器系统以其独特的自主性代替人类作出决策，因而切断了战争罪责任模式中的因果链条，造成问责空白的问题。

本文首先对致命性自主武器系统的特性以及国际刑法中对战争罪构成之规定进行分析。其次，探讨了该系统对战争罪责任模式造成冲击的原理。最后，结合我国实际情况提出对策，面对致命性自主武器给传统法律带来的冲击，我国应在完善国内立法与相关理论体系的前提下，与其他国家积极展开合作，通过构建新的国际法机制以对致命性自主武器系统进行合理的法律管控。

Based on the development of artificial intelligence technology， the lethal autonomous weapons systems provide a new way for the innovation of combat，but it also has an impact on the traditional laws and customs of war. The lethal autonomous weapons systems could complete a series of actions from searching targets to striking without human intervention. It takes the place of human beings to make decisions with its unique autonomy，thus cutting off the causal chain in the mode of war crime responsibility and creating the problem of accountability gap.

This paper first analyzes the characteristics of lethal autonomous weapons system and the constitution of war crimes in international criminal law，then discusses the impact of the systems on the accountability of war crimes. Finally，combined with the situation of our country，this paper puts forward countermeasures. We shall cooperate with other countries on the premise of improving the domestic legislation and relevant theoretical system，and control the lethal autonomous weapons system by building a new international law mechanism.
