国际贸易中的知识产权侵权给国际间正常的贸易秩序造成了严重的影响，每年因假冒和盗版贸易给世界经济、各国政府和消费者造成的损失超过万亿美元。知识产权边境保护制度以其在进出口环节打击知识产权侵权的突出作用而被世界各国普遍接受。中国以《知识产权海关保护条例》作为海关边境执法的主要法律依据，对包括进出口环节在内的所有受中国法律保护的专利权、著作权和商标权实施保护。中国知识产权边境保护范围已经远远超过了世界的普遍保护水平，超出了中国海关的实际保护能力。中国的知识产权边境保护虽然取得了一些成就，但是在一些方面还存在着问题。专利权作为知识产权权利体系中的权利类型之一，其也在中国知识产权边境保护的范围之内。但是，由于专利本身的专业性和专利侵权的复杂性，导致海关在实际的执法过程中，查处专利侵权的效果并不理想。本文选择专利权边境保护进行论述，对专利权边境保护的现状、问题进行分析，并提出完善意见。文章第一部分主要介绍专利权边境保护的基本概念，包括专利权的分类、授予条件、审查制度，知识产权边境保护的概念和历史沿革，专利权边境保护的国内和国际立法实践。第二部分介绍中国专利权边境保护的现状及其原因，重点从专利制度本身具有的特点以及专利权海关保护制度的立法规定方面进行分析。第三部分针对海关执法所面临的问题提出专利权边境保护的完善意见，其主要包括缩小海关依职权保护的范围，改革出口环节海关保护制度以及加强海关与有关机构的合作等。

The infringement of intellectual property right in international trade has seriously disturbed the normal trade order of international trade. Each year, the counterfeiting and piracy goods exert more than trillions of dollars lost on world economy, governments and consumers. Thus, it has been generally accepted by the world that border protection of intellectual property right plays a prominent role in fighting against infringement in import and export,“Regulation of the P. R. China on the customs protection of IP rights” as the main basis for China Customs, protects all patent, copyright and trademark in import and export. The scope of border protection of intellectual property in China has far exceeded the general level of the world, and beyond the practical ability of protection of Chinese Customs. Although border protection of intellectual property in China has made some achievements, there are still problems in some areas of protection.Parent right as one of type of intellectual property rights is also within the scope of border protection of intellectual property in China. However, because the patent has the expertise and the complexity of patent infringement, the Customs in the enforcement process, the effect of investigated patent infringement is not satisfactory. This article chooses the border protection of patent right to discuss, analysis the status and problems of border protection of patent right, and then put forward suggestions for improvement.The first part introduces the basic concepts of patent border protection, including patent classification, grant conditions, review system, the concept of border protection of intellectual property rights and history, patents border protection practices of domestic and international legislation. The second part introduces the status and the reasons of China's patent border protection, and analysis the characteristics of the patent right and provisions of the Customs protection of patent legislation. The third part according to the issues faced by Customs and put forward suggestions on the patent border protection, including narrow the scope of protection of the Customs in accordance with his duty, reform border protection of the export sector and strengthen customs cooperation with relevant agencies and so on.
