大学生利用课余时间从事兼职活动的普遍性和兼职权益屡受严重侵害，使得对大学生兼职权益的保护行动迫在眉睫。学界和司法界关于大学生在进行兼职活动中所形成的法律关系应该归属于雇佣关系还是劳动关系一直存在较大争议，本文将兼职行为依据其类别不同分为两种情况：当兼职大学生为自然人提供劳动或服务时，形成雇佣关系；当其为法人提供劳动或服务时，形成劳动关系。由于国外大学生利用课余时间进行兼职行为的现象出现得较早，因此在兼职大学生劳动权益保障领域的经验相较于我国更加丰富。本文在吸收国外较为成熟的保障措施的基础上，结合我国的具体情况，从国家、高校和大学生自身三个层面出发，提出一套相对全面且合理可行的劳动权益保障措施，以期最大程度地保护兼职大学生的劳动权益。

The universality of the behavior of college students taking part in concurrent jobs and the repeated deprivation of their rights, makes the protection of the labor rights of university students with concurrent jobs very imperative. Aacademia and judicial circles, with regards to whether the legal relationship formed during taking part in part-time activities by college students should affiliated to employment relations or labor relations, has always exist high controversy. This paper will split it into two according to the different categories of part-time behavior: the employment relations formed when college students provide works or services for private or individual households, and the labor relations formed when they provide works or services for employing units. Since the phenomenon of foreign university students participating in part-time jobs appeared earlier, the experience in the field of guaranteeing the labor rights of college students who attain concurrent jobs is relatively abundant. This article based on the absorption of foreign fairly mature security measures, combined with the specific situation of our country, and propose a relatively comprehensive, reasonable and feasible college students part-time labor rights protection measures, from the layers of country, universities and college students themselves, in order to maximize the protection of the labor rights of college students.
