商品房预售是房地产市场常见的房屋买卖形式,预售商品房抵押也是开 发商融资的重要方式。我国预售商品房抵押制度借鉴英美法系的房屋按揭制 度而设立,不可避免地,与我国既有的抵押制度存在一些不同或矛盾之处。 在实践和理论中,对于预售商品房抵押的抵押标的,抵押预告登记,以及在 建工程抵押与预售商品房抵押权冲突等问题存在很多争议。本文将首先简单 概括并介绍预售商品房抵押的概念以及相关预售商品房抵押制度的法律法 规,而后对预售商品房抵押中的一些具有争议性的问题进行简要分析,最后 对于完善预售商品房抵押制度提出一些浅薄构想。

Selling the apartment in advance is a common form of business in the real estate market, and the mortgage of presale apartment has been an important financing ways of the developers. Chinese mortgage system of presale apartment has been established by learning the housing mortgage system of common law, inevitably, there exist some inappropriates places in the law system. Furthermore,in theory and practice, there are many disputes and problems in the aspects of the subject matter of the mortgage of presale apartment, the advance notice registration of mortgage, and conflicts in the construction mortgage and the presale commercial housing mortgage, etc. In this paper, for the first, the author will briefly summarizes and introduces the concept of the mortgage of resale commercial housing and regulations about this mortgage system; and then, analyzes some controversial problems about the mortgage of presale commercial housing; finally put forward some simple ideas to improve the mortgage system of pre-sale commercial housing.
