自贝卡利亚提出废除死刑这一概念以来，学界对于死刑的存废问题进行了十分全面的研究，从死刑制度的设置目的、理念、价值等方面做了非常详尽的探讨，在中国关于死刑存废的研究也是十分激烈，其中采取与死刑相当的替代刑罚来代替死刑这一理论得到学界的普遍认同，但是对于何种刑罚能够作为死刑的最佳替代措施仍未有定论，笔者认为在立足我国的司法状况的基础上来讨论替代刑的问题十分必要，在不增加刑种的情况下，通过充分完善我国现行的刑罚制度来找出最佳的替代措施方案。这样既可以节省司法资源又能是我国的刑罚规范更加科学。减刑制度作为刑罚的执行制度，它的完善对于在我国既有刑法中寻找出最佳的死刑替代措施这一问题上有非常重要的意义。本文着重研究我国减刑制度的缺陷对于学界普遍达成共识的死刑替代措施——死缓制度的影响上来分析我国减刑制度的完善措施以及具体的改善内容。
