健康是人民群众的追求,食品安全则是健康的基础。近年来,互联网订餐逐步普及,我国互联网订餐人数显著增长。随之而来的卫生环境差、经营地址与实际地址不符等问题频发,食品安全议题亦从基本需求转向追求卫生、健康与品质。党的二十大报告明确指出:“要加强食品药品监管工作,完善食品安全监督警示防治体制”。习近平总书记也强调:“要利用科技提升餐饮业质量安全管理水平,全面做好源头到终端全方位食品安全管理各项工作,严防、严管、严控食品安全监管风险,保障广大人民群众吃得放心又健康”。因此,提升互联网餐饮食品安全监管水平已成为当前学界研究的热点。

本研究基于整体性治理理论,采用案例研究法、文献研究法和实地调查法,对A市互联网餐饮消费者进行问卷调查,梳理出A市互联网餐饮食品安全监管模式、机构设置、商家现状和监管现状。研究发现,A市互联网餐饮食品安全监管存在政府监管不到位、互联网餐饮商户平台行为越界、消费者维权困难和社会监督不足等问题。分析其原因,主要包括相关法律法规不够完善、第三方外卖平台责任落实不到位、消费者对外卖食品监管参与度低和政府监管部门合作度不高。这些因素共同导致A市互联网餐饮食品安全监管处于孤立和碎片化状态,影响了互联网食品安全的有效保障,危害了A市互联网餐饮食品安全环境。

基于A市的现实问题,本研究提出以下建议:一是逐步提高市场准入门槛,构建科学的互联网餐饮企业食品安全监管模式;二是夯实互联网餐饮平台责任,落实对商家的考核评价制度;三是加强消费者对互联网餐饮食品安全责任的监督;四是共同推动营造良好的互联网食品安全监管社会环境。通过资源整合形成良性互动,保障监管执法有法可依,达到严法善治的效果。

Health is the pursuit of the people, and food safety is the foundation of health. In recent years, as Internet food ordering has become a trend, the number of Internet food ordering in China has shown an increasing trend. However, with the emergence of problems such as poor hygiene environment and discrepancies between business addresses and actual addresses, it has caused difficulties for relevant departments to supervise. The report of the 20th National Congress of the Communist Party of China pointed out that "we should strengthen the supervision of food and drugs, and improve the food safety supervision, warning and prevention system.".Therefore, improve the level of food safety supervision has become the current academic research hotspots.

Based on the holistic governance theory, this study used case study, literature study and field survey methods to conduct a questionnaire survey on the consumers of Internet catering in City A, and sorted out the content of the food safety supervision mode, institutional settings, business status and supervision status of Internet catering in City A. It found that there were problems in the food safety supervision of Internet catering in City A, such as inadequate government supervision, cross-border behavior of Internet catering business platforms, difficulties in consumer rights protection and insufficient social supervision. It also analyzed the reasons behind the problems, mainly including: first, the relevant laws and regulations were not perfect; Secondly, the responsibility of third-party food delivery platforms is not fully implemented; Thirdly, the participation of consumers in the supervision of food sales to the outside world is low; Fourthly, the cooperation between government regulatory departments is not high. Together, it led to the isolation and fragmentation of the Internet food safety supervision in City A, which led to the inability to effectively guarantee the Internet food safety and endangered the Internet food safety environment in City A.

Based on the practical problems of City A puts forward corresponding suggestions: first, gradually improve the market access threshold and build a scientific food safety supervision model for Internet catering enterprises; Second, consolidate the responsibility of the Internet catering platform and implement the assessment and evaluation system for merchants; Third, consumers should supervise the further implementation of food safety responsibilities for Internet catering; The fourth is to jointly promote the creation of a good social environment for Internet food safety supervision, and form a benign interaction through resource integration, so as to ensure that there are laws for supervision and law enforcement, achieve the effect of strict law and good governance, and let consumers eat at ease and comfort.
