在全球化、信息化和网络化的新治理时代,冲破固化的官僚科层制的政府治理结构,构建政府部门之间协作关系,通过跨部门协同治理对行业发展和社会诉求做出整体性回应,是我国政府改革的新趋势。在城市建设管理领域,始于1996年的城市管理综合执法体制改革,城乡规划、环境保护及等多个行政监管部门已经将部分的行政处罚权集中划转至综合执法队伍,各地逐步组建完成综合执法力量,初步形成了“一支队伍管城市管理执法”的治理模式。新的治理模式在一定程度上缓解了多头执法、重复执法的痼疾,初步形成了整体治理的工作格局,但同时综合执法权面临协同阻滞困境。推动行政监管和综合执法有机衔接,促进监管部门、综合执法队伍的跨部门协同联动是政府机构改革取得效果的必要保障。 本文以K市城市建设管理领域跨部门协同治理实践为例,通过问卷调研的实证研究,发现存在条块分割、承接能力不足、信息共享机制缺失以及协同机制缺失等协同治理困境。本文运用整体政府理论、协同治理理论,分别从制度安排与整合、激励与结构势能、政治权威以及协同的结果等四个维度分析了协同治理困境发生的深层次原因。研究发现,跨部门协同机制依赖纵向政治权威的维系,导致了协同缺乏持续性、制度性;从单一执法到综合执法,条线分割的隔离仍然存在,条线整合的协同任务依然艰巨;缺乏有效的选择性激励机制,导致牵头部门与协同部门协同阻滞;多权威中心下的协同失灵,政治权力的高位推动有助于打破部门的隔离壁垒;协同治理的效果依赖个人和组织的良好合作历史。结合综合执法改革实际,对优化行业监管与综合执法部门协同治理实践,提出了优化建议。 |

In the new era of globalization informatization, and networking, breaking through the rigid bureaucratic governance structure of government department is the new trend in China's government reform ,including building collaborative relationships between government departments, and responding to industry development and social demands through cross departmental collaborative. The comprehensive law enforcement system reform of urban management, which began in 1996, involved multiple administrative regulatory depart-ments such as urban planning departments and environmental protection departments. Someof the administrative powers have been transferred to the law enforcement team. Various regions have gradually establish a "1+5" comprehensive law enforcement team. The new governance model has alleviated the chronic problem of multiple and repetitive law enforcement, but at the same time, the comprehensive law enforcement power is facing the dilemma of fragmentation,manifested in the fragmentation of law enforcement resources, law enforcement linkage, and law enforcement coordination mechanisms. Promoting the organicconnection between administrative supervision and law enforcement. Promoting cross-departmental coordination between regulatory and comprehensive law enforcement departments is a necessary guarantee for achieving results in the reform of the large department system.
This article takes the cross-departmental collaborative governance practice in the field of urban management in K city as an example. Through questionnaire research and empirical research, it is found that there are difficulties in collaborative governance, such as segmentation, insufficient capacity, lack of information sharing mechanisms, and lack of collaborative mechanisms. This article uses the theory of holistic government and collaborative governance to analyze the deep-seated reasons for the dilemma of collaborative governance from four dimensions: institutional arrangement , integration, incentives and structural potential, political authority, and the results of collaboration. Based on the actual situation of comprehensive law enforcement reform, optimization suggestions have been put forward to optimize the collaborative practice between supervision and comprehensive law enforcement departments. |
