本文的研究对象是同人作品，同人作品是利用原作品元素，倾注创作者心血的“二次创作”产物，集依附性、独创性特征于一身。依附性使其难以脱离与原作的联系而深陷侵权风波，独创性却又将其从抄袭、剽窃的泥淖中解救出来。互联网科技手段的发展推动了传播范围的急剧扩张，在资本的染指下非营利性特征式微，商业性逐渐抬头，至此侵权冲突再次加剧。面对愈演愈烈的权利冲突，虽然我国在经典个案的审判上没有令人失望，但确立统一的审判标准、建设科学权威的法律规制体系才是成文法国家应当作出的行动。本文的最大亮点就在于见微知著，通过细碎问题的逐个分析解决，慢慢摸索成体系的法律规制路径。
本文首先对同人作品的相关概念进行阐述，在理论层面对概念、法律性质、分类标准进行界定，为后续问题的研究提供理论依据。紧接着，对同人创作的侵权争议进行细致研究，为后续法律规制方法的确立提供事实依据。现阶段，我国著作权法在同人作品的侵权认定上存在较大缺陷：思想与表达界限不清、实质性相似判断不明、合理使用制度僵化且三步检验标准过于抽象，以上种种使得同人作品处于法律弱势地位。反不正当竞争法的兜底性适用存在二次评价的嫌疑，过分保护造成权利膨胀，限缩了同人创作的发展空间。如何平衡原作者和二次创作者的利益？应侧重权利保障还是鼓励创作？在对同人作品保护的必要性和法律规制的可行性进行分析后，以上问题得到了解答。应当把握规制与保护并重原则，以著作权法律规制为主、谦抑适用反不正当竞争法作为补充，与此同时借助法律手段之外的其他方法平衡两者冲突，营造和谐的创作环境。至此，同人作品的法律规制体系得以建立。

This paper firstly elaborates on the concept of fan work, and defines the concept, legal nature and classification standard at the theoretical level, so as to provide a theoretical basis for the study of the subsequent issues. After that, the infringement dispute of the fan work is studied in detail, to provide the factual basis for the establishment of the subsequent legal regulation method. At this stage, China's copyright law in the infringement of homo sapiens works on the determination of the existence of large defects: ideas and expression of unclear boundaries, substantive similarity of the judgment is unclear, the fair use of the system is rigid and the three-step test is too abstract, all of the above makes the fan work in a weak position in the law. The anti-unfair competition law has the suspicion of secondary evaluation, and the excessive protection has resulted in the expansion of rights and limited the development space of fan work. How to balance the interests of original authors and secondary creators? Should we focus on protecting rights or encouraging creativity?After analyzing the necessity of protection of fan work and the feasibility of legal regulation, the above questions have been answered. The principle of equal importance of regulation and protection should be grasped, and the regulation of copyright law should be the main focus, supplemented by the modest application of the anti-unfair competition law, and at the same time, the conflict between the two should be balanced with the help of other methods other than legal means, so as to create a harmonious environment for creativity. Thus, the legal regulation system of fan work has been established.
