法律是一种肯定、明确和普遍的行为规范，稳定性是它最基本的属性之一，而作为一国之内具有最高法律权威的宪法，稳定性更是影响其至上权威，进而关乎整个宪政和法治全局的关键因素。本文将首先讨论宪法的稳定性与社会变迁的关系，而后从分析我国现行宪法自 1982 年以来的变迁情况出发，评论我国的宪法变迁方式对宪法稳定性的影响，提出要充分发挥宪法解释的作用，谨慎修改宪法时亦应从“政策性修宪”模式转变到“制度性修宪”上来，以调和宪法的稳定性与社会变革之间的矛盾。此外，本文还指出我国相对频繁的宪法变迁，一方面是由于社会变迁，另一方面则是立法上规则和技术的漏洞加剧 了这一形势。对于正处于社会转型期的我国来讲，随着政治、经济制度的变革和发展，宪法的变迁是必要的，但若抱着宪法功利论的观点，在立法的规则和技术方面不作细致研究，这样的宪法变迁势必对宪法的稳定性产生消极影响，这是我们目前建设社会主义宪政和法治国家应该竭力避免的。

Law is a kind of affirmative, explicit and universal norm for behaviors, thus the quality of stability is one of its most fundamental characteristics. As supreme law, the constitution enjoys the highest level of legal authority in one country and consequently, the acquirement of stability is more essential for it could influence the whole situation of constitutionalism and the rule of law. In this paper, we will analyze the specific changing of the constitution in China, particularly the four modifications since 1982, to evaluate the stability of the constitution. Our conclusion is: the main reason of the relatively frequent changing of the constitution in China is the high-speed development of society, especially the social transformation, although at the mean time, the leaks of our legislative technology worsen the situation. Along with the development of economics and politics of China, changing of the constitution is necessary and inevitable; however, if we hold a utilitarian view toward the constitution and do not pay enough attention to our legislative technology, such changing may negatively influence the stability of the constitution.
