近年来的研究表明，团伙犯罪在未成年人犯罪中占很大比例，未成年人团伙犯罪已经成为未成年人犯罪的主要形式。与单独的犯罪相比，团伙犯罪具有更大的社会危害性。结伙犯罪不仅降低了犯罪成本，同时也提高了犯罪的成功率。未成年人在团伙中习得犯罪技能，主观恶意和人身危害性都被扩大，很容易成为惯犯并渐渐成为职业犯罪人。因而，对未成年人团伙犯罪的研究应当成为我国治理未成年人犯罪的重要突破点。对任何一种犯罪现象的治理都不应该单纯的“兵来将挡水来土掩”，而应该追根溯源全面了解诱发犯罪的各种因素及其作用机制，只有如此，才能真正做到“对症下药”，制定出合理有效的防治措施。本文遵循犯罪研究中从事实到观念再到规范的分析思路来解析未成年人团伙犯罪的生成机理，以此为基础探讨未成年人团伙犯罪的预防对策。本文共分为四个部分。第一部分为未成年人团伙犯罪概述。此部分阐述了未成年人团伙犯罪涉及的相关概念，重点梳理了当前未成年人犯罪的现状。理清概念和现状是对犯罪现象进行研究的基础，只有从事实层面上弄清楚犯罪现象呈现什么样的特征，才能够准确把握未成年人团伙犯罪的真实状况。第二部分笔者引进了标签理论，并总结了标签理论的主要观点。在此基础上，把标签理论与未成年人团伙犯罪相结合，分析了从标签理论的视角探讨未成年人团伙犯罪的价值和意义，为下文用标签理论分析未成年人团伙犯罪的生成进行了铺垫。第三部分笔者详细分析了标签理论视角下未成年人团伙犯罪如何生成的过程。这部分笔者指明了标签的来源和标定主体，分析了家庭、学校、同辈群体、社区、大众传媒这些标定主体的反应对未成年人行为的重要意义，并详细阐述了标签对未成年人自我认知、结成团伙和实施犯罪所产生的负面影响。第四部分笔者对构建未成年人团伙犯罪的预防体系提出了建议。基于前文的分析，笔者认为构建未成年人团伙犯罪的预防体系应当以“弱化标签”为指导原则，只有在此基础上提出的防治措施才符合本文的研究初衷。然后，提出了微观层面的可行措施并提出构建和完善我国的少年司法制度，包括前科消灭制度、轻罪犯罪记录封存制度和社区矫正制度。关于未成年人犯罪的原因分析的研究很多，但专门研究未成年人团伙犯罪的著作和成果还比较匮乏，本文试图以标签理论来分析未成年团伙犯罪的生成，希望为团伙犯罪生成的解读提供不同的视角，为理论研究的深入和对策的改进提供有益的参考和借鉴。

In recent years, researchers has shown that gang crime makes up a large proportion of juvenile delinquency. Juvenile gang crime has become the main form of minor crime. Compared with the crime alone, gang crime is more harmful to the society. Gang crime not only reduces the cost, but also improves the success rate of crime. Minors acquires skills in the gang crime. Their subjective malice and personal danger have been expanding and it is easy to become a habitual offender and become a professional criminal. Therefore, the study of minors gang crime should become an important breakthrough of the management of minor crime in our country.For any kind of crime phenomenon, the governance should not be a simple "punches have means to resist", but should be traced back a comprehensive understanding of the factors to bring out crime and its mechanism of action. Only then can we truly achieve "suit the remedy to the case" and develop reasonable and effective control measures. This article follows the analysis method of the fact to the concept then the norm in the generation mechanism of juvenile gang crime study .Then on this basis to explore prevention countermeasures of juvenile gang crime.This article altogether is divided into four parts.The first part is the summary of juvenile gang crime. This part expounds the related concepts of minors organized crime, focuses on the current status of minor crime. Clarifying concepts and current situation is the basis of the study of crime phenomenon. Only being clear the characteristics of crime phenomenon in the fact can accurately grasp the real condition of juvenile gang crime.In the second part the author introduces the labeling theory, and sums up the main ideas of the theory. On this basis, the labeling theory combines with juvenile gang crime. From the perspective of labeling theory the author analyzes the value and significance of juvenile gang crime study. The study paves the way for using labeling theory to analyze the formation of organized crime minors on the next stage.In the third part the author analyzes the process of how to generate minors gang crime from the perspective of labeling theory. In this part the author points out the label source and calibration of the main body, analyzes the significance of the subject's reaction of the family, school, peer groups, community, mass media .Also the author expounds on the label’s negative impact of minors’ self-cognition, forming groups and committing a crime.In the fourth part the author gives suggestions for the construction of juvenile gang crime prevention system. Based on the analysis above, the author thinks that construction of juvenile gang crime prevention system should be guided by the principle of "reduction label". Only based on this, the measures meet the purpose of this study. Then, the author puts forward feasible measures in micro-level and constructs and improves our country's juvenile justice system, including record elimination system, misdemeanor criminal record storage system and the system of community correction.There are a lot of researches on the analysis of the causes of minors crime, but works and results specializing in juvenile gang's are relatively scarce. This paper attempts to use labeling theory to analyze the formation of organized gang crime. The author wants to provides a different perspective for the further theoretical research and advances useful reference of improving countermeasures.
