校园欺凌行为的侵权责任研究对补偿被欺凌者，惩戒欺凌者和遏制校园欺凌现象的发生具有重要的现实意义。结合我国现有的涉及校园欺凌的案例中欺凌行为的特点，可将校园欺凌行为界定为“发生在校园内外、由与学生有一定关系的人实施的，故意通过肢体、语言及网络等方式对学生进行心理或肉体上的攻击，使其感到内心痛苦，或造成其身体伤害、财产损失的行为”。校园欺凌行为是典型的侵权行为，其侵权责任构成符合违法行为、损害事实、因果关系和过错四要件。根据责任主体不同，校园欺凌行为的侵权责任形态可分为成年欺凌者的单独责任、按份责任、连带责任，未成年欺凌者的监护人完全的补充责任，学校等教育机构在不同情形下的与过错相适应有限责任、有限的补充责任，以及学校与教职工的连带责任。被欺凌者有权向所有侵权人请求人身、财产和精神损害赔偿。

The research on the tort liability of school bullying is of great practical significance for compensating the victims, punishing the bullies and restraining school bullying. In light of the existing cases of school bullying in China, school bullying can be defined as "any gesture or act that occurs inside or outside the campus and is committed by someone who has a certain relationship with the student, who intentionally attacks the student by means including but not restricting to body, language and Internet, causing harm to the student physically or emotionally, or the student’s property". School bullying is a typical tort, and its tort liability consists of illegal act, damage fact, causality and fault. According to the different subjects of responsibility, the types of tort liability of school bullying can be divided into individual liability, joint liability and proportionate liability of adult bullies, and complete supplementary liability of guardian of juvenile bullies, under different circumstances, schools and other educational institutions bear limited liability, limited supplementary liability, and joint and several liability between schools and teaching staff. Victims have the right to claim compensation for personal, property and mental damage from all tortfeasors.
