随着《中国-东盟全面经济合作框架协议服务贸易协议》的签署,当前中国-东盟自由贸易区的建设步步深入,作为中国-东盟自由贸易区建设基石之一的争端解决机制发挥越来越大的作用。本文从介绍中国-东盟争端解决模式入手,阐述了该争端解决模式对中国-东盟双方关系的影响,然后分析当今主要区域贸易中的争端解决模式的特点及其国际关系因素,对比总结出中国-东盟自由贸易区争端解决的特点,并深入分析了其形成的国际关系因素及其发展方向,最后提出了该模式的完善方案和建议。全文分四个部分,第一部分,首先介绍了中国-东盟争端解决模式的法律渊源和主要内容,然后指出其对中国和东盟经贸关系和政治关系的影响。指出该争端解决模式是实施《框架协议》的各项原则和措施的有力保障,为双方经贸争端解决提供了一种有效、可靠和规则取向的制度性安排,同时有助于双方利益的进一步开发争端解决模式和为各成员参加争端解决提供了可能性。第二部分,分析了当今主要的自由贸易区争端解决模式及其国际关系因素。相近的经济发展水平与长期发展起来的高效组织机构决定了欧盟司法化争端解决模式;三国经济的不同层次性、美国的主导作用、只有三个参与国的特点决定了北美自由贸易区实行了准司法性争端解决模式;松散的地区性组织、内部实行“共同一致”的决策机制、每一个成员均有否决权、缺少核心和强有力的领导和各国间错综复杂的关系决定了东盟实行的是协商性争端解决模式。第三部分,分析了东盟内部复杂关系及中国和东盟各国的关系对争端解决模式的巨大影响。东盟内部的不一致性导致中国-东盟自由贸易区的建设,不是中国和东盟双边的谈判,而是通过中国和东盟各国逐个谈判签署多边协议来实现,加上东盟各国长期来和中国的复杂关系,使得该中国-东盟争端解决模式是以仲裁为核心,强调磋商的模式。第四部分 从结构设置、与WTO法律重叠、适用范围三个方面提出完善的建议和方案。

As the China-the ASEAN Framework Agreement on Comprehensive Economic Cooperation Agreement on Trade in Services signed, the building of China-the ASEAN Free Trade Area is going in-depth step by step. Dispute settlement mechanism of China - the ASEAN Free Trade Area-- one of the cornerstones, is playing a growing role. Beginning with the introduction of China-the ASEAN Free Trade Area dispute settlement pattern, this paper clarifies the impact of ASEAN relations between the two sides from the dispute settlement pattern, and Analyzes the characteristics and international relations factors among today's major regional trade dispute settlement, and Sums up the characteristics of China-the ASEAN Free Trade Area dispute settlement pattern by contrast, and deeply analyzes international relations in the formation and the development direction. Finally, it shows the advice and recommendations to perfect China-the ASEAN Free Trade Area dispute settlement pattern.The full text includes four parts. In the first part, it introduces Legal sources and Main content of China - the ASEAN dispute settlement pattern. Then it tells us its economic and political impact between China and ASEAN. It points out that the dispute settlement pattern is the implementation of the "framework agreement" to the principles and measures for effective protection, providing an effective, reliable and rules-oriented institutional arrangements for bilateral economic and trade dispute settlement. At the same time the dispute settlement pattern helps to further the interests of both sides and development for all members to participate in providing the possibility to resolve the dispute. In the second part, it analyzes the dispute settlement patterns of current major free trade areas and its international relations factors. Similar level, long-term development of the efficient organization decides the judicial pattern of EU dispute settlement. Three different levels of economy, the leading role of the United States, only three countries, decide the quasi-judicial dispute settlement pattern of the NAFTA. Loose regional organization, the "common consensus" decision-making mechanism within, every member’s veto power, lack of strong core leadership and complicated relations between countries, etc. tell us consultation dispute settlement pattern is best for the ASEAN.In the third part, it analyses the tremendous impact on the dispute settlement pattern from the complex relations within the ASEAN, and relations between China and the ASEAN countries. The ASEAN internal inconsistency is not good for the building of China-the ASEAN Free Trade Area. It is not bilateral negotiations between China and the ASEAN, but China and the ASEAN countries one by one negotiate to achieve multilateral agreements. The ASEAN countries and China have been a complex relationship for a long time. So the dispute settlement pattern for China-the ASEAN sets arbitration as the core, and stresses consultation.In the fourth part, it makes recommendation and programs to improve the pattern from the structural set-up, WTO laws overlap and the scope of application.
