人工智能技术的普及应用在传播领域迎来智能传播时代,其中“算法新闻”的兴起是智能算法技术在新闻传播领域的落地应用。国内外比较常见且智能化程度相对较高的应用场景有机器新闻写作、算法推荐、社交机器人,对应到一般传播模式里作为传者、中介、受者。算法新闻的出现对信息传播带来较多不可控因素,在具体应用场景中出现侵害著作权、隐私权等合法权益,舆论操控,追责困难等算法风险。技术改进无法解决的公共风险需要法律的介入,现有的治理路径是否能适应智能传播时代以及维护良好传播生态值得研究。本文从算法新闻的三个典型应用案例着手,对算法接入新闻、全方位参与信息传播中所涉及的具体法律问题进行整体研究,将具体风险类型化,识别算法操纵、算法黑箱、算法权力等法律风险,通过聚焦到具体法律问题,兼具考虑算法规制的场景化以及新闻传播领域的整体性,借助规范分析、案例分析,探讨现有治理路径的可行性和内在缺陷,提出明确治理目标、构建权力制约为基础的多元主体治理体系、完善内容监管制度和算法透明等调适建议。正文内容具体包括以下四个部分:

第一部分作为算法新闻的概述,提炼概括算法新闻兴起所处于的算法技术水平以及传播生态背景情况,结合传播学视角,从信息生产、分发、互动三个环节综合介绍算法新闻具体应用场景,展现算法作为传播者和传播中介给新闻传播领域带来的整体变革。

第二部分基于算法新闻的技术水平以及已有的规范文件、现实案例,探究算法新闻的法律性质,将算法新闻引入法律视野之中。以此为基础分析算法新闻应用法律风险,根据具体现象即算法操纵的渗透、算法黑箱的失控,逐步深入透视算法风险本质也即算法权力的异化。

第三部分以算法新闻的法律风险为基础,从内容治理和技术规制两个层面分析现有的关于算法新闻的法律治理回应,基于算法新闻的独立价值分析其中存在立法规范模糊分散、多元治理依靠平台责任义务的内在治理缺陷。

第四部分基于更好构建算法新闻的传播生态,针对治理目标、治理框架思路、内容监管制度、算法透明等提出相应的调适建议。

The popularization and application of artificial intelligence technology has ushered in the era of intelligent communication in the field of communication, among which the rise of "algorithmic news" is the application of intelligent algorithm technology in the field of news communication. The more common and intelligent application scenarios at home and abroad include robot journalism, algorithmic recommendation, and social robots, which correspond to the general communication model as transmitter, intermediary, and recipient. The emergence of algorithmic news brings more uncontrollable factors to information dissemination, and there are algorithmic risks in specific application scenarios such as infringement of copyright, privacy and other legal rights, manipulation of public opinion, and difficulties in pursuing responsibility. The public risks that cannot be solved by technical improvements require legal intervention, and it is worth studying whether the existing regulation path can adapt to the era of intelligent communication and maintain a good communication ecology. This paper starts from three typical application cases of algorithmic news, conducts an overall study of the specific legal issues involved in algorithmic access to news and all-round participation in information dissemination, typifies specific risks, identifies legal risks such as algorithmic manipulation, algorithmic black box, algorithmic power, etc. By focusing on specific legal issues and considering both the scenario of algorithmic law regulation and the overall nature of the news dissemination field, with the help of normative analysis, By focusing on specific legal issues, considering both the scenario of algorithmic regulation and the overall news communication field, we explore the feasibility and inherent shortcomings of the existing governance path with the help of normative analysis and case analysis, and put forward adaptation suggestions such as clarifying governance goals, building a governance system of multiple subjects based on power constraints, improving the content regulation system and algorithmic transparency. The main text consists of four specific parts as follows:

The first part, as an overview of algorithmic news, distills and summarizes the technical level of algorithms and the background situation of the communication ecology in which algorithmic news emerged, combines the perspective of communication science, introduces the specific application scenarios of algorithmic news from three aspects of information production, distribution and interaction, and shows the overall changes brought by algorithms as communicators and communication intermediaries to the field of news communication.

The second part explores the legal nature of algorithmic news based on the technical level of algorithmic news as well as the existing regulatory documents and real-life cases, and introduces algorithmic news into the legal perspective. Based on this, the legal risks of algorithmic news application are analyzed, and the essence of algorithmic risks, i.e., the alienation of algorithmic power, is gradually penetrated in depth according to specific phenomena, i.e., the penetration of algorithmic manipulation and the loss of control of algorithmic black box.

Based on the legal risks of algorithmic news, the third part analyzes the existing legal governance responses on algorithmic news from two levels: content governance and technical regulation, and analyzes the inherent governance defects of vague and scattered legislative norms and multiple governance relying on platform responsibility and obligation based on the independent value of algorithmic news.

The fourth part proposes corresponding adaptation suggestions based on better construction of the communication ecology of algorithmic news, with respect to governance objectives, governance framework ideas, content regulation system, and algorithmic transparency.
