随着互联网和短视频产业的发展，短视频创作呈大众化、普遍化趋势，未经作品著作权人许可而使用他人作品的行为现象愈发频繁。这抑制了原创者的创作积极性，激发了作品著作权人、社会公众、短视频平台的利益冲突。一些使用行为构成剽窃，是当下短视频著作权侵权行为的重要类型，判断合理借鉴与剽窃的界限的关键在于对他人作品具体又具有独创性的表达的借鉴是否构成实质性相似。在这一背景下，以情景剧类短视频为例，讨论短视频剽窃的认定标准和认定方法。

With the development of the Internet and short video industry, the creation of short video is popular and universal, and the behavior of using others' works without the permission of copyright owners becomes more and more frequent, which suppresses the enthusiasm of original creators, and the conflicts of interests of copyright owners, the public and short video platforms are gradually prominent. Some uses constitute plagiarism, which is an important type of copyright infringement of short videos at present. The key to judge the boundary between reasonable reference and plagiarism lies in whether the reference for the specific and original expression of others' works constitutes substantially similar. In this context, this paper takes melodrama short video as an example to discuss the identification standards and methods of short video plagiarism.
