产品安全是一件关乎消费者的生命健康和财产安全，同时也关系到社会稳定和国家长治久安的事情，保障产品安全是生产者、销售者乃至国家和社会的一项重要责任。我国《产品质量法》和《标准化法》中都提到了产品标准对于产品安全的规制保护，因此，研究先进的标准体系及其在产品安全规制中的作用，成为一项极有意义的课题。 欧盟的标准化管理具有很强的先进性，它以技术法规和协调标准分离的形式对产品安全进行控制，并将加帖CE标志作为产品进入市场流通的安全性保障。 欧盟的《通用产品安全指令》界定了安全产品，并明确将协调标准作为推定产品安全的重要依据，使欧盟的产品安全保护提升到一个新的水平。研究欧盟的标准化体系及其在产品安全的法律规制中发挥的作用，对于发展我国的标准化体系，加强我国产品安全的法律规制具有重大的意义。本论文即通过对欧盟的标准化体系和产品安全规制的考察，对比我国的现状，根据我国的现实情况提出了相关的建议。 本论文主要内容共分为四章： 第一章是关于标准化及认证制度的概述。本章首先界定了标准化的定义，并对其历史和现状的介绍，阐述我国国家标准的制定及实施过程，然后介绍了认证制度的概念及我国关于产品认证的相关规定，主要目的是为后文奠定基础。 第二章主要介绍欧盟现行的标准化体系。欧盟的标准化体系包括技术法规和协调标准，其中，技术法规主要规定产品在安全、健康、环境和消费者保护等方面所应达到的基本要求，协调标准规定产品为达到技术法规的要求而应采用的技术指标，并赋予使用者自愿选用的权利，凡采纳协调标准进行生产的则被推定为安全，而采用其他标准生产的产品则需要进行安全评估。最后, 欧盟通过强制产品加贴CE标志来确保进入欧洲市场的产品的安全性。 第三章主要分析协调标准在欧盟产品安全法律规制中的作用。欧盟主要经历了技术协调时期、新方法指令时期和通用产品安全指令保护时期，每一个时期都代表着欧盟对于产品安全保护的一次飞跃，现今，欧盟对于产品安全的保护已经位居世界前列。 第四章介绍我国目前的标准化现状，并分析其存在的一系列问题，在此基础上根据我国的实际情况，以欧盟经验作为借鉴，提出完善我国标准化体系以及产品安全规制方面的设想和建议。

Product safety is not only a matter of life, health and property safety, but also involve in the social and state stability. It is an important responsibility for the producers and sellers. As a way of protecting the product safety, product standard is mentioned in “Product Quality Law” and “Standardization Law”. So, it is of significance for us to study the advanced standard system and its effect to the product safety. Standardization of the European Union (EU) is advanced in the world. It adopts technical regulations and coordinating Standards to control the product safety, and makes the CE mark to be the permit of EU market. In “General Product Safety Directive”, EU defines the product safefy, and makes the coordinating Standards as important basis of presumption of product safety. It elevates the product safety protection to a new level. It is of significance for our country to study the EU’s standard system and its regulation of product safety. This paper mainly studies the EU’s standard system and its regulation of product safety, and gives some suggestions according to the current situation. This paper consists of four chapters: The first chapter is the overview of the Standardization and certification system. First, this chapter refines the Standardization, presents its historical and current situation, and shows its function. Then, it briefs the certification system. This chapter mainly lays the foundation of later discussion. The second chapter mainly introduces EU’s current standardization system. It contains technical regulations and coordinating standards. The technical regulations mainly regulate some basic requirements on safety, health, circumstance and consumer protection. The coordinating standards stipulate the technical indicators for the technical regulations. They are not forced to be used. If the producer chooses the coordinating standards, the products will be regarded as safety, while, if the producer chooses other standards, the products should be tested. Finally, the products must to be attached CE mark as safety. The third chapter mainly presents the role of coordinating standards in legal regulation of product safety. EU goes through the technical coordination period, the new method Directive period and the General Product Safety Directive period. Each period represents the improvement of products safety protection. Now, EU has been the front in the world. The forth chapter expounds the current situation of our country’s standardization and analyses the problems we have. Based on this and drawed on the experience of EU, the author proposes some suggestions to develop our standard system and product safety protection.
