国家对防控犯罪至关重要,长久以来人们对此深信不疑。而现实社会中,也都是由国家主导开展各类反犯罪活动,这既能满足社会对防控犯罪产品的需求,又有利于资源的调配、整合和利用,还能有效地保障人权。然而,不得不注意的是,虽然国家主导着反犯罪进程的基本走向,但路线方针的贯彻实施绝不可能脱离其他社会组织、团体和公众的积极参与。随着社会经济的发展进步,人类对犯罪现象的认识不断深化,日益深刻理解“刑法也不是惟一的甚至不是主要的对付犯罪的工具”的真正内涵。另一方面,社会结构的转变以及国家治理方式的调整都在一定程度上促进了社会力量,包括各类新兴组织、民间团体尤其是企业组织,在国家治理犯罪进程中的角色地位日益凸显,作用亦在不断增强。就我国而言,当前正处于经济改革和社会结构调整的关键时期,但日益严重的犯罪问题深深地困扰国家和各级政府,并极大地影响着社会的安全稳定和经济的进一步发展。在此大背景下,有效防控犯罪自然而然成为国家和全体社会共同面临的一个重大课题。本论文采取从具体个案切入,层层深入剖析,并逐渐拓宽研究范围的研究方式,在具体论证过程中,又综合运用社会学、经济学的分析方法,结合政治学、刑事法学、刑事政策学的基本理论,力图说明在参与式社会格局中,企业不仅仅是追求利益最大化的“经济人”,还是维护社会环境健康的“社会人”。对于国家来说,合理借助企业力量,既可以解决社会转型期间日趋严峻的犯罪治理中司法资源供给不足的问题,又可以顺应“全能国家”向“有限国家”转变的步伐,并为刑事司法领域改革提供鲜活的经验。除导论和结语外,本文分二大部分:第1、3、4章是对一个被判处缓刑青少年在企业基地帮教考察案例的调查和分析;第5、6、7章则力图放宽视野,整理归纳企业犯罪防控体系的其他现象,从而在一般意义上分析企业参与的正当性、目的和价值,初步尝试对企业参与反犯罪进程予以理论构建。具体而言,第1章主要是考察浙江省某一基层法院对青少年缓刑犯适用企业帮教活动的个案,描述了一种司法机关借助民营企业力量开展对缓刑犯的监管治理工作。第2章则在分析个案之前,对涉及的基本概念分别做了界定,并归纳总结了有关刑事政策和企业的基础理论,以便为下文的进一步分析打下基础。第3章回到企业帮教,运用社会学、经济学等方法,并以曾经在我国广泛运用的社会帮教活动做参照物,系统而全面对现在民营企业积极参与帮教活动的行为进行剖析。第4章主要分析了国家对企业参与帮教活动的态度,从规范层面上看,中央并没有对企业参与犯罪治理活动作出具体的规定,但是实践中采取的有关措施从却不同的角度隐射出国家支持的姿态,而东部经济较为发达地区的司法机关更是积极推动企业尤其是民营企业加入到犯罪治理进程之中。第5章在简单回顾中国企业在国家犯罪治理中角色变迁的基础上,进一步讨论企业组织在不同的历史时期因其所承担社会职能的差别,在治理犯罪活动中发挥着迥然相异的作用。第6章主要对企业参与犯罪治理的其他现象进行整理,包括各国企业在犯罪预防、刑事司法和犯罪矫正等不同环节的具体表现,从而论证在犯罪防控领域中,国家与企业二者关系密切,交错互动。第7章尝试构建企业参与反犯罪进程的正当性,并反思企业参与活动的若干局限性,进而指出,国家应当对企业参与现象通过法律、合同、政策等多种方式对其进行有效监管,以期达到双赢的局面。总而言之,在我国企业参与犯罪防控仍然属新生事物。本文从刑事政策的角度阐述了企业力量在增加供给、优化资源配置、提高效率等方面的作用,也探讨了如何进行有效规则的问题。当然,笔者的研究仅仅是从法学、政治学、社会学等角度对中国企业力量进行观察分析的一个小小起点。因为中国的发展仍在持续进行中,而各种类型的企业特别是民营企业将会成为社会主义市场经济的主力军,其对于中国特色社会主义事业建设的成败,对于社会主义制度优越性的大小,对于社会安全稳定、公平正义、和谐文明和政治民主贡献的高低,将有着举足轻重的影响。正因为此,中国的企业值得我们认真而持续的关注!最后,本文的创新点主要是:首次将企业纳入犯罪防控领域,从实践和理论两层面分析企业在该领域所具有的显著地位和积极作用。在当前经济快速发展、社会结构显著变化的大背景下,国家逐步认识到应当积极主动地整合各种社会力量,尤其是新兴的企业组织,以填补国家犯罪治理行为间的空白地带。同时,我们也应当理性客观地看到企业在犯罪防控中的价值和作用,既予以支持、鼓励,又要对其进行有效规制,从而最大限度地发挥企业在此进程中所展现的经济和组织的双重优势,达到社会和谐发展的基本目标。
外文摘要:
The state has the primary responsibility for prevention and control of crime in modern society. As we all know, state is the best one that provide efficient security and defend human right., but, we have to notice the importance of the civil society including the third party organizations, the enterprises participant in anti-crime activities though the state dominate the orientation. With the development of economic and society, people continuously deepen their understanding of the criminal phenomenon, and they gradually accumulated their experience and preventive measures in fighting against crimes. On the other side, conversion of the society structure and governance stimulates the status and function of organisations in society including the enterprise becoming more and more prominent. As for our country, it’s the key period of economic reform, the crime wave is so rough that it is hard for the government to deal with. And, the enterprises play an increasing important role in the process of striking crimes, and their positions are rising.Ⅰ. Main Content of the Dissertation The dissertation falls into nine parts.First is the introduction. Chapter 1 describes the informal enterprise-participation practice in Eastern China, a probation exercise in the private enterprise. Chapter 2 analyzes the concept of ciminal policy and enterprise. Chapter 3 applies the economic theory to reveal the reasons that the enterprise are inclined to participate in criminal control. Chapter 4 addresses the official policies to enterprise-participation, There are some explaination for the official’s attitude. Chapter 5 declear the Role Transformation of Chinese enterprise in the Criminal Policy. Chapter 6 takes the informal the juvenile probationer by enterprise as enterprise-participation, discusses the interaction among security-company, private-prisons. Chapter 7 discusses the legitimacy of enterprise-participation, tries to achieve country control on enterprise-participation through law. Accordingly, it is important to understand both the factors which underlie the growth of enterprise-participation and the moral, historical, penological and political arguments which have been put forward in opposition. As a conclusion, I call on to take seriously to enterprise-participation in criminal policy, make it function positively, limit and channel its negative functions, and construct a multiple crime control mechanism under which the governments, the enterprises, the non-government orgnizations interplay conducively. Ⅱ. Major Innovations of this Dissertation1. For the first time, the author systematically demonstrates the remarkable value and positive function of Chinese enterprises in criminal policy from evaluation and fact aspects, and puts forward that the value and function of civil society in the process of striking crime should be given serious consideration, so as to effectively integrate various resources in civil society to strike crime and fully activate the great potential of civil society to strike crime.2. For the first time, taking a historical analytic approach, the author makes a vertical comparison of the role change and function transformation of enterprises in the process of anti-crime when the People’s Republic of China appeared, and then analyzes the cause and reveals the theoretical support.3. For the first time, the author makes a systematic analysis and a detailed discuss of the different orgnizations enterprises play different roles in criminal policy, such as security companies, private prisons, community corrections, and so on. 4. For the first time, the author discusses the remodeling of enterprises’ function and status in criminal policy. The author also puts forward and demonstrates the idea that the relationship between the state and enterprise should be transformed from assistant participant style to cooperative and supportive style.5. For the first time, the author poses the two concepts --exclusive governance domain and common governance domain and describes their formation background, scope division as well as the relationship between the authorities (the state) and civil society within the common governance domain.6. As for methodology, the author introduces the theory of governance as an instrument to analyze the cooperative relationship between the authorities (the state) and civil society into criminal policy system for the first time; meanwhile, the author also uses many theoretical instruments of economics and sociology, and so innovation in analytic methodology is realized.
