长期以来,我国对社会组织实行业务主管单位和民政部门登记管理的双重管理制度,极大地制约了社会组织的发展,造成我国社会组织发育不充分,许多组织面临自身生存发展诸多问题,在许多领域都不能有效参与到社会事务的管理中来,所提供的社会福利服务非常有限,很难承接相应的社会管理职能,难以形成有效的多主体参与的社会机制。本文从实证研究的角度,以深圳正在进行的社会组织登记管理制度改革为例,从五个部分对我国社会组织登记管理制度变革趋势进行了深入分析。第一,从概念上厘清了社会组织、非政府组织,对国内外研究社会组织的文献进行了梳理和归纳。第二,对我国社会组织、社会组织登记管理的基本情况作了简要叙述。第三,重点分析了深圳市社会组织登记管理制度改革的背景。第四,深入分析深圳市从2004年开始的社会组织登记管理制度改革。最后,从改变我国社会组织管理理念、改革社会组织登记管理制度和监督管理制度、为社会组织发育成长创造条件的角度提出我国社会组织登记管理制度改革的建议。本文认为,深圳市的改革理顺了社会组织与政府管理的关系,理顺了登记管理与监督管理的关系,理顺了社会组织发展与自律的关系,突出了社会组织发展重点,即重点培育行业协会商会、社区民间组织等自益性组织,重点培育社工服务、公益慈善、环保等互益性组织,使社会组织在促进经济社会协调发展方面、在维护社会稳定方面、参与社会管理和公共服务方面、在促进社会公益、增进社会福利方面、在实现社会公平正义方面有了广阔的发展空间。本文认为,未来我国社会组织管理理念将从限制控制向培育引导转变,政府与社会组织的关系也将从依附关系向合作伙伴转变,政府将转变对社会组织的管理制度,从限制登记管理向降低门槛建立全方位全覆盖的监督管理体制转变,在管理方式上,将推动社会组织独立法人地位,推进组织内部民主管理,以评估规范社会组织的管理和运作,建立社会组织网络组织,为社会组织发展搭建平台,建立制度化、规范化的公共财政支持体系,为社会组织发展提供资金支持,最终实现政府、市场、社会组织的多元治理模式。

Since the late 1980s, a dual administrative system has been applied to Chinese social organizations, meaning all Chinese social organizations report both to competent departments of different trades and civil administration. This system has largely limited the prosperity of social organizations in China, resulting in many Chinese social organizations operating physically under difficult conditions. Quite often, Chinese social organizations find themselves unable to participate effectively in social activities and the service they provide is constrained; they can hardly shoulder relevant social functions and become part of a multi-agent civil society.Adopting an evidence-based research approach, this article takes the reform of social organization registration and administration system in Shenzhen as a case, analyzes comprehensively the trends of social organization registration and administration system reform in the following 5 parts: 1/ To clarify the definitions on social organization and non-governmental organization on the basis of reviewing and summing up Chinese and international publications on social organization; 2/ To describe briefly the actual existence of Chinese social organizations and the registration and administration system applied to social organizations in China; 3/ To analyze specifically the context of the reform of social organization registration and administration system in Shenzhen; 4/ To further analyze the reform of social organization registration and administration system in Shenzhen since 2004; 5/ To raise suggestions on social organization registration and administration system reform in China which focuses on a change in administrative concept regarding social organization and better living and working conditions for social organizations.Through the analysis of the reform of social organization registration and administration system in Shenzhen, this article shows that the reform in Shenzhen has made clear the relations between social organizations and government, the relations between registration administration and supervision administration, as well as the relations between the growth of social organizations and their self-regulation. Key measures to benefit the social organizations include focusing on cultivating self-benefited organizations such as industrial associations, chambers of commerce, and community groups, and encouraging mutual-benefited organizations in fields of social work, charity, environment protection, etc, which ensure that a large space has been made to the development of social organizations in terms of promoting harmonious socio-economic development, maintaining social stability, participating in public service delivery and social management, enhancing social welfare and realizing social justice.This article points out that in the future, the administrative concepts of social organizations will transform from restricting and controlling to nurturing and guiding. Meanwhile, the government will also change the way of managing social organizations; the threshold for registration will be lowered; and an all-round supervision and management system will be set up. In terms of management, Chinese government will promote the independent legal status of social organizations, enhance democratic management for the organizations, develop an evaluation system for the management and operation of social organizations, establish a network for social organizations, set up a platform to facilitate social organization development, build systematic, standardized public finance support system, provide financial support for social organizations, and achieve the ultimate goal of building a multi-agent civil society participated by the government, market and social organizations.
