随着经济全球化与科技的飞速发展,在电子商务概念基础之上发展而来的数字贸易,逐渐成为新兴的国际贸易类型,并占据越来越重要的地位,数字贸易当中税收、知识产权等主要议题,成为国际经济与法律领域的关注重点。安全与监管,更是在如今贸易争端频发的背景下备受关注,《数字经济伙伴关系协定》(以下简称DEPA)是2020年签订的国际上影响力比较大的专门化区域数字经济协定,在中国积极加入DEPA的背景下,本文关注DEPA当中有关数字安全与监管的内容,研究中国加入DEPA的进程中需要注意的问题,并提出对策建议。 文章主要分为绪言和正文四章共五个部分。 在绪言部分,首先阐明了本文研究的理论和实践意义,并分数字贸易、数字贸易中的安全与监管以及对各区域经贸协定(以下简称RTAs)中这一领域三个层次,对研究现状进行了简要概括,总结出,以DEPA中的数字安全与监管规则为主要研究对象,进行各RTAs之间规则文本对比的研究较少这一现状。从中国如何与DEPA中数字安全与监管规则相适应的角度,叙述本文的研究内容和方法。 第一章对本文认为的DEPA当中属于数字安全与监管范围的规则进行界定,作为文章的研究基础。并阐释DEPA这一新兴数字贸易规则之于数字贸易安全的意义,同时梳理中国立法实践中主要的数字安全与监管规则现状,初步提出在DEPA具有如此重要意义的前提下,中国当前这一领域的法治实践与DEPA无法完全契合的问题。 第二章以WTO框架中的《服务贸易总协定》(以下简称GATS)和比较典型的RTAs《全面与进步跨太平洋伙伴关系协定》(以下简称CPTPP)、《美国-墨西哥-加拿大协定》(以下简称USMCA)、《区域全面经济伙伴关系框架协定》(以下简称RCEP)作为规则对比对象进行分析研究。在其数字贸易/电子商务章节中选取了数据跨境流动、个人信息保护、政府数据开放等相应规则做横向对比,主要阐述WTO目前关于数字安全与监管缺乏专门规制、DEPA对“美式模板”的承继和发展以及中国已经加入的RCEP同DEPA之间的差异,在这些分析中表明DEPA对构建全球性规则的重要意义、DEPA本身在“美式模板”基础上保留的数字贸易自由优先的总体规则特点以及各协议之于中国参与国际数字治理的影响,将其作为分析中国加入DEPA之策略建议的基础。 第三章以前两部分为基础,详述目前中国在国内立法实践以及国际治理两个层面,加入DEPA的现实困境差异以及原因。其中重点在于当前发展阶段,中国更加重视安全的立场与国际上数字贸易自由化的价值取向有冲突,数字安全与监管规则也不够完善。 第四章就国内和国际两个层面,提出对策建议,认为中国应当采取在DEPA语境下完善数字安全与监管规则体系、建立专门机构以及在国际上提出数字贸易规则“中式模板”等措施,以更好地加入DEPA并借此寻求在国际数字治理中贡献更多智慧和力量。 |

With the rapid development of economic globalization and technology, digital trade developed on the basis of the concept of e-commerce has gradually become an emerging type of international trade and occupies an increasingly important position, and the main issues of taxation and intellectual property rights in digital trade have increasingly become the focus of attention in the field of international economy and law. Security and regulation, but also in today's trade disputes frequently under the background of attention, DEPA is the 2020 signing of the international influence of the specialization of the regional digital economy agreement, in the context of China's active accession to DEPA, this paper focuses on DEPA’s digital security and regulatory rules, China's accession to DEPA, and put forward recommendations. The first part is the introduction, which firstly clarifies the theoretical and practical significance of the research in this paper, and divides three levels, digital trade, security and regulation in digital trade, and this area in the regional economic and trade agreements (hereinafter referred to as the RTAs), and briefly summarizes the current research status. Currently, there are fewer studies that take the digital security and regulatory rules in DEPA as the main object of research, and conduct comparisons of the text of the rules among RTAs, as well as between them and the World Trade Organization (hereinafter referred to as the WTO).Finally, the research content and methodology of this paper are described from the perspective of how China adapts to the digital security and regulatory rules in DEPA. The second part proposes the research problem of the whole article, defines the rules belonging to the scope of digital security and regulation in DEPA as the research basis of the article. It also explains the significance of DEPA as an emerging digital trade rule for digital trade security, and at the same time combs through the status quo of the main digital security and regulatory rules in China's legislative practice, and preliminarily proposes that China's current legislative practice in this field is not fully compatible with DEPA. The third part analyzes and researches GATS and the typical RTAs ,like CPTPP,USMCA, RCEP as the object of rule comparison. In the chapter on digital trade/e-commerce, the corresponding rules on cross-border flow of data, protection of personal information, and open government data are selected for horizontal comparison, mainly elaborating on the lack of WTO's current specialized regulation on digital security and regulation, the inheritance and development of DEPA's "U.S.-style template", as well as the differences between the RCEP and DEPA. In these analyses, the significance of DEPA for the construction of global rules, the features of the rules of DEPA itself, and the impact of the agreements on China's participation in the international digital governance, which is a prerequisite for the formulation of China's strategic proposals for its accession to DEPA. Based on the previous two parts, Part Four analyzes in detail the differences in China's real-life dilemmas in joining DEPA and the reasons for them, both at the level of domestic legislation and practice and at the level of international governance. The fifth part also proposes countermeasures at both the domestic and international levels, arguing that China should take measures such as improving the legal system for digital security and regulation in the context of DEPA, establishing a specialized agency, and proposing a "Chinese template" for digital trade rules in the international arena, in order to better participate in DEPA and to seek to contribute more wisdom and strength to international digital governance. |
