随着世界经济一体化进程的加快,劳工权益保护也逐渐超出了一国的范围,开始了其国际化的进程。一方面,国际劳工组织的成立以及国际劳工标准的制定为各成员国建立一个公开的可遵守的标准,各成员国通过批准和加入公约的方式履行劳工权益保障的职能。另一方面,劳工权益保护渗透到国家之间的贸易往来之中,发达国家希望在国际贸易体系中建立一套劳工标准制度,将劳工权益保护的条款写入贸易协议;1996年12月,在新加坡WTO首次部长级会议上,以美国和欧盟为首的发达国家就要求将劳工标准问题作为今后的工作日程写进部长会议宣传。然而在70年代中期以来,经济全球化迅速扩张,跨国公司的全球投资及生产行为,弱化了政府的干预能力。一种由跨国公司为主体的、较为温和的劳工权益保护方式应运而生。跨国公司通自己在全球生产链条上的主体地位,制定生产守则,并要求其合作商也遵守和执行生产守则,或者通过为自己生产的产品贴上社会责任标签的方式把劳工权益的保护扩大到全球范围内。跨国公司制定的这些守则和制度被统称为自愿性劳工标准。自愿性劳工标准以其民间化、自主化、非谈判化的特有运作方式为劳工权益的国际化提供了一条新途径。 本文从五个方面来分析自愿性劳工标准对劳工权益国际化保护的推动作用。第一部分首先阐述了自愿性劳工标准的概念,介绍了自愿性劳工标准产生的背景、包括的内容以及特点;第二部分综述劳工权益的国际化保护并探讨了它的价值和意义。第三部分分别介绍了跨国公司的内部生产守则、第三方独立认证和产品社会责任标签制度的运行模式以及对劳工权益的国际化保护的推动作用,并结合世界品牌耐克以及社会责任国际制定的SA8000等案例进行解释和论证。第四部分分析了自愿性劳工标准在实施过程中存在障碍的原因和有待提升的地方。第五部分针对第四部分提出的原因提供了相应的解决方案和改善措施。

With the globalization of the world economy,the protection of labor rights and interests also go gradually beyond the scope of a country, beginning its international process. On one hand,the international Labor organization had established a public standard with which its member states comply. These member states fulfill their obligation by approving or acceding to the Conventions. On the other hand, labor rights protection has penetrated into the world trading. The developed countries hope to establish a set of labor standards for the international trading system and write the provisions of the protection of labor rights into the trade agreement.In December 1996, the first WTO ministerial conference was hold in Singapore. The developed countries headed by the United States and the European Union required that the issue of labor standard should be written into the council of ministers’ work schedule. However, since the middle of 70's, with the rapid expansion of economic globalization, the global investment and production practices of Multi-National Corporations have weakened the government's ability to intervene. Under this circumstance, the multinational companies initiate a more moderate method of labor rights’ protection-the Voluntary Labor Standards. Multinational companies take advantage of their predominant position in the global production chain, set down their own codes of conduct and ask the compliance of their partners. They also label for their products, reading that the production process is in line with the requirements of labor standards and the labors’ rights are well protected during the process. By these fork,autonomous and non-negotiated modes of operation, the voluntary labor standards facilitate the international protection of labors rights and interests,which also means providing a new way to the international protection of labor rights and interests. This thesis analyzes the voluntary labor standards and the international protection of labors rights and interests from five aspects. The first part explains the concept of voluntary labor standards, introduces the emergence background of voluntary labor standards, and includes the content and features. The second part introduces the international labor rights and interests protection and explores its value and significance. The third part respectively introduces the operation mode of Multi-National Corporation's internal codes of conduct, the independent third party certification and labeling system of the corporations’ social responsibility. The role of the voluntary labor standards playing to promote the international protection of labor rights and interests is emphatically discussed. The world brand Nike and international SA8000 social responsibility standard are referenced to explain and demonstrate these thoughts. The fourth part analyses the reasons why obstacles exist in the implementation process and the work which to be improved. The fifth part provides for the causes put forward in the fourth part with the corresponding solutions and improvement measures.
