进入信息网络时代,网络技术已重塑了人类的现代生活,并在现实社会之外构建了全新的虚拟网络空间。得益于网络技术的快速发展,人们的生产、工作、学习和生活方式发生了深刻的变化,然而网络技术发展也不可避免地带来了各类网络问题。近年来网络暴力事件频发,除了严重影响网络空间的生态环境,其造成的影响也已突破虚拟网络空间的限制从而渗入现实生活,危害被害人的名誉、隐私甚至身心健康与生命安全,网络暴力“按键伤人”“按键杀人”的事件屡见不鲜。让网暴者付出应有的代价已成为社会共识,但实践中民事、行政规制乏力,刑事规制又因无法适应网络暴力的特征而在治理方面收效甚微。因此,为了强化刑事规制在网络暴力治理中的关键作用,有必要对目前的刑事治理体系根据网络暴力的新特征进行针对性完善。

本研究旨在清朗网络空间风气,遏制当前网络暴力的猖獗态势。本文以网络暴力的现状和危害作为第一章,指出网络暴力在当下已具备极强的危害性,强调对网络暴力进行法治化治理的必要性和紧迫性,第二章到第四章以问题为导向,严格遵循提出问题、分析问题、解决问题的思路,综合运用文献研究、案例分析等方法,完整分析了网络暴力刑事规制目前存在的问题及问题的成因,并提出相应的完善建议。

现有的刑法规范固守传统线下暴力的犯罪构成,忽略了“网络+暴力”的新特质,使网络暴力刑事规制出现了罪名适用与实际脱节的情况,在治理方面收效甚微。因此本文回归网络暴力的本质,仍然以网络暴力的犯罪构成作为解决问题的关键,对网络暴力的犯罪构成要件及特征进行梳理,发掘“暴力”在网络空间中新的生成路径与表现方式,并以此为依据,将符合网络暴力特征的新犯罪构成要件还原到刑法规定中,提出扩大现有罪名覆盖范围、以“合理限度”为判断标准确定犯罪主观方面与犯罪主体,以及对网络暴力的结果进行合理评价的完善建议。

In the era of the information network, network technology has reshaped modern human life and has constructed a new virtual network space beyond the physical society. Thanks to the rapid development of network technology, profound changes have occurred in people's production, work, study, and lifestyle; however, the development of network technology inevitably brings various network issues. In recent years, incidents of online violence have occurred frequently. Apart from severely affecting the ecological environment of cyberspace, its impact has also transcended the boundaries of the virtual network space, infiltrating into real life and endangering the reputation, privacy, and even the physical and mental health and safety of victims. Cases of online violence, such as 'keyboard assault' and 'keyboard homicide,' are not uncommon. Making the perpetrators of cyber violence pay has become a social consensus, but in practice, civil and administrative regulations are weak, and criminal regulations are minimally effective in governance due to their inability to adapt to the characteristics of cyber violence. Therefore, to strengthen the critical role of criminal regulations in managing cyber violence, it is essential to specifically improve the current criminal governance system based on the new characteristics of cyber violence.

This study aims to clarify the cyberspace atmosphere and curb the rampant trend of online violence. The first chapter focuses on the current state and dangers of online violence, highlighting its potent harmfulness at present and emphasizing the necessity and urgency of legal governance over online violence. From the second to the fourth chapter, the discussion is problem-oriented, strictly following the approach of posing questions, analyzing problems, and solving them. Through a comprehensive application of literature research, case studies, and other methods, it thoroughly analyzes the existing issues and the causes of online violence criminal regulation, proposing corresponding improvement suggestions.

Current criminal law standards adhere strictly to traditional offline violence offenses, overlooking the new characteristics of 'cyber + violence,' leading to a disconnect between applicable charges and actual circumstances in cyber violence criminal regulation, resulting in minimal efficacy in governance. Therefore, this paper returns to the essence of cyber violence, still focusing on the criminal composition of cyber violence as the key to solving the problem. It organizes the elements and characteristics of cyber violence offenses, explores new pathways and expressions of 'violence' in cyberspace, and on this basis, restores the elements of new offenses that fit the characteristics of cyber violence back into the criminal law. It proposes expanding the coverage of existing charges, using 'reasonable limits' as the criteria for determining the subjective aspect and the agents of the crime, as well as suggestions for a reasoned assessment of the outcomes of cyber violence.
