全面依法治国是目前我党治国理政的重要思路,其中诉讼是重要环节,律师是关键主体。在众多类型的诉讼中,公益诉讼所涉及的利益较为特殊:通常影响大、范围广且所涉利益没有明确的产权。故在社会公共利益遭受损害时,通常没有人有意愿或有能力提起公益诉讼来维护公共利益。而公益律师群体的工作就是代理公益诉讼案件,他们是社会公共利益的维护者,其存在十分必要。但由于目前我国针对公益律师的激励不够,因此公益律师的数量较少且未能在公益诉讼中充分发挥作用。
根据我国的公益律师激励现状及存在的问题,本文从人力资本的视角研究了适合公益律师的激励措施,并针对现存问题提出了改进建议。研究发现,当前我国公益律师获得的激励主要来自其自身的社会责任感和政府及社会的部分支持,其人力资本改善没有得到足够的重视。因此,本文提出从公益律师的社会地位、绩效、培训、职业规划和薪酬等方面来保持或增加其人力资本以实现激励,进而为改善我国公益诉讼质量奠定人力资源基础。

The overall rule by law is an important way for our Party to govern the country, among which litigation is the important link, and lawyer is the key person. In all kinds of lawsuits, the interest of public interest litigation has some special points: usually its effect is larger and wider, and the interest involved is of no clear property rights. Therefore, when the public interest is damaged, no one has the will or ability to bring up public interest litigation, which may lead the public interest lacking of due protection. As a full-time agent of public interest case, Public Interest Lawyer is the defender of social public interest. However, due to the lack of incentive measures, the number of Public Interest Lawyer in China is rare, and they fails to play a full role in public interest litigation.
According to the present situation and existing problems of Public Interest Lawyer in China, the research studies the incentives for Public Interest Lawyer from the perspective of human capital theory, and then puts forward some suggestions on improvement. Moreover, This study finds that the current incentives for Public Interest Lawyer are mainly come from their own sense of social responsibility and a little support from the government and society, but the improvement of their human capital is neglected. Therefore, the study suggests increasing the human capital of Public Interest Lawyer from the aspects of social status, performance appraisal, training, career planning and welfare, in order to lay a human resource foundation for improving the present situation in our country.
