随着家庭暴力问题的层出不穷，受虐妇女杀夫行为也逐渐成为了社会广泛关注的热点问题，然而此类行为的定罪量刑问题在法学界和司法实务界尚未形成一个统一的标准。本文通过梳理133个裁判案件，总结家暴受虐妇女杀夫案件的认定与处理现状以及争议问题，在此基础上结合故意犯罪与正当防卫理论，对受虐妇女杀夫行为的有关争议问题进行深入分析，提出受虐妇女杀夫行为构成故意杀人罪、故意伤害罪（致死）的判断标准，同时从正当防卫的五要件出发，深入探讨正当防卫理论在此类案件中的适用空间。而对于此类案件的量刑问题，本文引入了“受虐妇女综合症”理论，并结合被害人过错理论提出有关量刑建议，意在为家暴受虐妇女杀夫行为的量刑提供有价值的参考。

With the emergence of domestic violence, the behavior of battered women killing their husbands has gradually become a hot issue of social concern. However, the convicting and sentencing of such cases has not yet formed a unified standard among law experts and judicial practice. By analyzing 133 adjudicated cases, the author summarizes the current situations and issues of judicial cognizance of these cases. And on this basis, combining with the theories of intentional crime and justifiable defense, the author makes an in-depth analysis on the issues in the dispute of the battered women killing their husbands and puts forward the criterion for judgment whether these behaviors constitute the crime of intentional homicide or intentional injury. At the same time, on the basis of the five elements of justifiable defense, the author discusses in depth whether the theory of justifiable defense is suitable for these cases. In addition, by introducing the theory of “battered women syndrome” and combining with the victim's fault theory, the author puts forward some sentencing suggestion, which is intended to provide a valuable reference for the sentencing of the battered women killing their husbands.
