大数据背景下,记忆与遗忘的传统伦理关系受到前所未有的挑战,因此被遗忘权逐渐走进大众视野。自2012年1月25日欧盟委员会公布GDPR 草案到2018年5月25日GDPR法案正式生效期间,有关被遗忘权的立法一直众说纷纭。而几乎同时,美国加州通过了橡皮擦法案,要求美国的社交网络服务商允许加州的未成年人擦除自己的上网痕迹。一时间中国国内法律学者纷纷撰文对被遗忘权本土化立法展开讨论。如果说国内的上述讨论仅仅是流于理论的话,那么北京一中院于2015年公布的一份判决书则在实践层面对被遗忘权做出回应。宪法由于其最高的法律地位必然要对新兴权利做出回应,所以本文主要从宪法学角度对被遗忘权进行介绍、分析。 本文从五个章节,三个层次展开研究。通过分析大数据时代被遗忘权的基本问题,研究被遗忘权的宪法属性,分析域外国家和地区关于被遗忘权的立法,提出关于我国被遗忘权的立法建议。第一章绪论介绍选题的研究意义、国内外的研究现状、研究的主要内容、拟解决的关键问题。第二章研究大数据时代被遗忘权的基本问题。先介绍被遗忘权及大数据的概念,再结合大数据时代数据搜索的优势点以及被遗忘权对大数据时代的促进作用,谈谈大数据时代研究被遗忘权的必要性。第三章讨论大数据时代被遗忘权的宪法属性。首先简要介绍法学界关于被遗忘权属性的四种争论:属于隐私权、属于财产权、属于信息自决权、涉及人的尊严;接着探讨宪法视角下被遗忘权是否构成一项独立的基本权利。第四章介绍并分析域外国家和地区关于被遗忘权的立法。通过三个域外国家的法案,深入分析其内在的宪法精神、立法宗旨以及局限性、所引发的社会问题。第五章提出被遗忘权本土化的立法建议。这一章着重介绍国内学者对被遗忘权本土化的观点,同时笔者针对目前国内的立法现状提出对被遗忘权本土化的看法,分析被遗忘权与言论自由的冲突以及遗忘权与公民知情权的冲突,同时探讨将比例原则从行政法升格到宪法以解决被遗忘权的立法是否具有可行性。并在宏观、微观层面分别提出立法建议。

In the context of big data, the traditional ethical relationship between memory and forgetting has been challenged as never before, so the right to be forgotten has gradually entered the public eye. Since the publication of the GDPR draft by the European Commission on January 25, 2012 and the official implementation of the GDPR Act on May 25, 2018, the legislation on the right to be forgotten has been widely debated. At about the same time, California passed the Eraser Act, requiring US social network service providers to allow minors in California to erase their online traces. For a time, Chinese domestic legal scholars have written articles on the localization legislation of the right to be forgotten. If the above-mentioned domestic discussion is only in theory, then a judgment issued by Beijing No. 1 Intermediate People's Court in 2015 will respond to the right to be forgotten at the practical level. Because the constitution must respond to emerging rights because of its highest legal status, this paper mainly introduces and analyzes the right to be forgotten from the perspective of constitutional law. This paper starts with five chapters and three levels. By analyzing the basic issues of the right to be forgotten in the era of big data, this paper studies the constitutional attributes of the right to be forgotten, analyzes the legislation on the right to be forgotten in extraterritorial countries and regions, and proposes legislative proposals on the right to be forgotten in China. The first chapter introduces the research significance of the topic, the research status at home and abroad, the main content of the research, and the key issues to be solved. The second chapter studies the basic issues of the right to be forgotten in the era of big data. First introduce the concept of forgotten right and big data, combined with the advantages of data search in the era of big data and the promotion of the right to forget in the era of big data, talk about the necessity of studying the right to forget in the era of big data. The third chapter discusses the constitutional attributes of the right to be forgotten in the era of big data. Firstly, it briefly introduces the four controversies in the legal circle about the attributes of the right to be forgotten: belonging to the right to privacy, belonging to property rights, belonging to the right to self-determination of information, involving human dignity; and then discussing whether the right to be forgotten constitutes an independent basic right under the constitutional perspective. The fourth chapter introduces and analyzes the legislation on the right to be forgotten in extraterritorial countries and regions. Through the bills of three countries outside the country, an in-depth analysis of its internal constitutional spirit, legislative purposes and limitations, and social problems caused. The fifth chapter proposes legislative proposals for the localization of the right to be forgotten. This chapter focuses on the domestic scholars' views on the localization of the right to be forgotten. At the same time, the author puts forward the view on the localization of the forgotten right in the current domestic legislation, analyzes the conflict between the right to forget and freedom of speech, and the right to forget and the right to know. The conflict, while exploring the feasibility of upgrading the principle of proportionality from administrative law to constitution to resolve the right to be forgotten. And propose legislative proposals at the macro and micro levels.
