为了最大化地实现“物尽其用”、促进商品的自由流转，我国的抵押物转让立法在《民法典》颁行之后进入自由转让时代，该立法转变成为我国抵押物转让立法的一个重要里程碑。然而现行立法对于抵押物转让制度的适用情形、法律后果等方面并未作出细化规定，导致抵押权人实现抵押权所面临的风险增加,因此如何更好地在抵押物转让过程中保障抵押权人的利益成为有待于理论与实务界进一步探究的重要命题。本文尝试先后通过回溯抵押物转让的立法演变过程、分析抵押物转让中抵押权人利益保护的理论基础、发掘当前立法背景下抵押权人利益保护所面临的困境、探索域外抵押物转让立法中能够为我国借鉴的立法经验，最终总结得出在抵押物转让中保护抵押权人利益的可行性制度完善措施。

In order to maximize the realization of "the best use of goods" and promote the free flow of commodities, China's legislation on the transfer of mortgages has entered into the era of free transfer after the promulgation of the Civil Code, and this legislative change has become an important milestone in China's legislation on the transfer of mortgages. However, the current legislation for the application of the system, the legal consequences and other aspects did not make detailed provisions, in the new legislative model, the mortgagee to realize the mortgage risk increases, how to better protect the interests of the mortgagee has become an important proposition to be further explored in the theoretical and practical circles. This paper tries to apply the research idea from discovering problem to analyzing problem to solving problem, successively through retrospecting the legislative evolution process of mortgage transfer, analyzing the theoretical foundation of mortgage protection in mortgage transfer, discovering the dilemmas faced by mortgage protection in the current legislative background, exploring the legislative experience that can be borrowed by our country in the legislation of extra-territorial mortgage transfer, and finally summarizing the feasible measures for the improvement of protecting mortgagees' benefits properly during the assignment of mortgages.
