虽然我国刑法第196条对信用卡诈骗罪作出了明确的规定，但是由于社会经济的迅猛发展和科技进步的日新月异，这些规定仍然存在着许多缺陷，完善信用卡诈骗罪相关立法势在必行。本文主要是对我国刑法中“信用卡诈骗罪”的内涵、构成要件、立法内容进行探讨，立足于当前我国信用卡诈骗罪相关立法的缺陷，并在借鉴国外部分发达国家相关经验的基础上，建议从以下几个方面完善我国信用卡诈骗罪的相关规定：盗窃信用卡并使用的按照信用卡诈骗罪定罪处罚；增加“使用变造的信用卡”的情形作为法定情形之一；单位也可以作为本罪的主体；对网络信用卡诈骗行为加以明确规定；增加限制信用的资格刑。

Though the Criminal Law of our country has made clear and concrete regulations to the Crime of Swindling with the Credit Card, it has many defects because of the limitations of the development and the age. Improve the legislation of crime of fraud of the credit card is necessary. The article is going to talk about the connotation, constitutive requirements and legislative content of "the crime of fraud of the credit card" in our criminal law. Based on the current defects of our country's legislation of crime of fraud of the credit card, and and in part draw lessons from foreign developed countries on the basis of relevant experience. It can perfect our country's credit card crime of fraud of the rules from the following several aspects: Stealing credit card and using must be treated as the crime of fraud of the credit card; Adding that using altered credit card; Company also can be the subject of the crime; Credit card fraud to specific provision for the Internet; Adding that the qualification punishment of limiting credit.
