随着我国社会经济发展和利益格局的深刻调整,社会矛盾敏感复杂且易发多变。一方面,人民调解功能面临许多新的挑战和难题;另一方面,人民法院近年来受理案件逐年攀升,部分经济发达地区法院的司法审判更是超负荷运行。因此,积极整合社会力量,建立健全诉讼与非诉讼有机衔接、相互协调的多元化纠纷解决机制,大力发展多元化纠纷解决机制成为社会发展不可逆转的趋势。调解既可以为广大人民群众提供高效、便捷、低成本的纠纷解决方式,也可以提升社会治理的法治化水平,减少社会矛盾。党的十八届四中全会确定了多元化纠纷解决机制的改革任务,鼓励通过调解解决矛盾,并将其上升到国家治理体系和治理能力现代化整体战略高度,这也是当今世界非诉讼纠纷解决机制(ADR)时代趋势和法治发展的创新。
调解制度在我国历史悠久,人民调解制度更是中国特色社会主义司法制度中不可或缺的部分,发挥着社会纠纷化解、维护社会稳定和谐的重要作用。社会纠纷化解是人民调解员的主要职责,因此,加强人民调解员队伍建设,提高人民调解员工作质量是完成调解工作的根本保证。律师调解作为多元化纠纷解决体系中典型的存在形态,由于参与主体的专业性,自然增强了这一纠纷化解方式的吸引力和实效性。在当前“案多人少”背景下,探索和确立律师调解制度已成为不可逆转的趋势,律师参与人民调解工作既可以弥补人民调解员在一些专业性较强纠纷上的不足,也为当事人提供新的纠纷解决渠道。
2017年10月,最高人民法院、司法部联合发布《关于开展律师调解试点工作的意见》,在北京、上海等11个省(直辖市)开展律师调解试点工作,标志着律师调解制度在我国初步确立。律师在我国的普及性以及自身在预防和化解矛盾纠纷中的专业优势、职业优势以及实践优势,使得纠纷解决更为便捷、高效,同时也使调解方案更具良好法律效应和社会效应。上海是全国开展律师调解工作先行试点城市之一,律师调解的参与程度较深。笔者采用案例研究法,选取上海闵行区两个有代表性的律师参与人民调解的信访案例作为研究样本,挖掘其颇具特色的改革成果和经验,从微观角度展示出律师参与多元化纠纷化解机制的创新做法和突出成效。当然,所列案例中也暴露出试点工作中存在的一些弊端,最大的问题就是律师参与度不高,推广难度较大,一定程度上阻碍了律师调解制度在我国的发展。在我国推进律师调解工作深入开展的同时,针对这些问题,本文在此提出一些关于健全完善律师调解制度的建议与今后的路径选择,以期能够真正发挥律师调解制度的巨大作用,促进国家、社会、公民之间在社会纠纷解决上的良性互动,维护社会整体和谐与稳定。

In the period of social transformation, with the rapid development of China's economy and the profound adjustment of interest pattern, social contradictions become more sensitive and complex. On the one hand, the people's mediation function is facing challenges; on the other hand, the judicial trial work is overloaded. In order to meet the diverse requirements of the people and cater to the realism of the country governing by law in the new era, China must vigorously develop a diversified dispute resolution mechanism. Diversified dispute settlement mechanism is an important part of the modernization of national governance system and governance capacity, as well as an important mechanism for the settlement of domestic and international contradictions and disputes. The Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China has determined the task of reforming the Alternative Dispute Resolution mechanism, encouraged the resolution of contradictions through mediation, and promoted it to the overall strategic level of modernization of the national governance system and governance capacity. This is also the trend of ADR and the innovation of the development of the rule of law in today's world.
Mediation system has a long history in China, and the people's mediation system is an indispensable part of the judicial system with Chinese characteristics. It plays a role in resolving social disputes and maintaining social stability and harmony. The resolution of social disputes is the main responsibility of the people's mediators. Therefore, strengthening the construction of the people's mediators and improving the quality of their work are fundamental to complete the mediation work. Lawyer mediation, as a typical form existed in the ADR system, its importance is self-evident. Under the current background of "cases explosion", it has become an irreversible trend to explore and establish the lawyer mediation system. Lawyers' participation in people's mediation can not only make up for their shortcomings in some professional disputes, but also provide new channels for the parties to resolve disputes.
In October 2017, the Supreme People's Court and the Ministry of Justice jointly issued the Opinions on Pilot Work of Developing the Lawyer Mediation, and since then, 11 provinces (or municipalities directly under the Central Government) such as Beijing, Shanghai and Zhejiang have carried out lawyer mediation pilot work nationwide, marking the preliminary establishment of lawyer mediation system in China. The popularity of lawyers in China and their professional, and practical advantages in preventing and resolving conflicts and disputes, make dispute resolution more convenient and efficient, with better legal and social effects. Shanghai is one of the first pilot cities to carry out lawyers' mediation in China, and lawyers' mediation participation is deeper. In this case, two representative cases of lawyers participating in mediating the complaints through letters and visits in Minhang District of Shanghai are selected as research samples, and their distinctive reform achievements and experiences are excavated to show the innovative practices and outstanding results of lawyers participating in diversified dispute resolution mechanism from a micro perspective. However, the cases also exposed some drawbacks in the pilot work, which hindered the development of lawyer mediation system in China to an extent. While promoting the lawyer mediation work in our country, aiming at the problems, this paper puts forward further suggestions on perfecting the lawyer mediation system and the routes to choose in the future, in order to make the best use of the lawyer mediation system, promote the benign interaction among the state, society and public in the settlement of social disputes, and maintain social harmony and stability.
