随着经济社会的发展与信息化时代数字资源在信息传递领域发挥的重要作用，传统的捐赠法律关系与捐赠制度也亟需发生变化。而《中华人民共和国公共图书馆法》的颁布为进一步研究数字资源捐赠制度提供了法律基础。本文以公共图书馆数字资源捐赠机制为切入，基于其特殊性分析现有法律制度下出现的相关法律问题，为广义虚拟财产捐赠制度的完善发展提供借鉴，挖掘《图书馆法》对公民文化权利的促进作用。

With the development of Chinese society and economy, digital resource has been more important in information transmission area, which also requests the transformation of traditional donation legal relationship and related legal system. Besides, the enforcement of the Law of the People’s Republic of China on Public Libraries provides legal basis for further research on digital resources donation system. Centering on the digital resources donation system for public libraries, this paper analysis legal problems based on its uniqueness under current donation legal system. In order to offer advice for further development of digital resources donation legal system and to dig the importance of promoting culture right.
