信托登记制度是将特定财产存在信托法律关系的事实向社会公示的制度设计，是大陆法系国家在信托领域内的一项基础性制度设计。信托登记制度能够保障信托财产安全、保护受益人的信托利益、维持交易秩序并为国家监管信托行业提供有效支撑。在没有衡平法保护的大陆法系国家，信托登记制度能够保障信托目的的实现，从而发挥信托制度“受人之托，代人理财”的作用。

我国《信托法》第十条对信托登记的财产范围以及信托登记的生效规则进行了基础地规定，目前信托登记的实务操作主要依据《慈善信托管理办法》和《信托登记管理办法》两个低位阶的法律文件。我国的信托制度仍存在很多缺陷。首先，法律法规没有对信托登记财产的范围进行明确规定，且信托登记效力也与信托登记制度的价值定位不符。其次，现有的信托登记机构无法律法规明确授权，导致我国现有信托登记不能产生法定的效力。最后，现有的信托产品登记内容不能满足信托公示的需求，且现有的信托登记未与现有的财产权属登记相衔接。

针对我国现有信托登记制度的不足，我国信托登记制度的完善需要完成以下工作：一是明确信托登记的财产范围并改采信托登记对抗主义；二是要明确信托登记机构，对于统一信托登记机构与分散信托登记机构进行比较，认为我国应选择分散的信托登记机构，将现有的财产权属登记机构作为信托登记机构，保障信托登记公信力和公示力，使信托登记的效率予以提高；三是要规范信托登记，改变现有信托产品登记内容不足的问题，对信托登记内容予以规范，明确信托登记内容应包含信托财产和信托法律关系两方面，从而满足公示的要求；四是信托登记的程序与现有的财产权属登记的程序相衔接，包括申请和审查两方面的内容，以期保证信托登记的准确性，同时提高信托登记的效率。

The trust registration system is a system design that publicizes the fact that a specific property has a legal relationship of trust to the public. The trust registration system can guarantee the security of trust property, protect the trust interests of beneficiaries, maintain the order of transactions and provide effective support for the national supervision of the trust. In countries with civil law systems that are not protected by equitable law, the trust registration system can guarantee the realization of the purpose of the trust, thereby exerting the trust system's role of "trusting and managing wealth on behalf of others"．
    Article 10 of China's "Trust Law" provides in principle the scope of trust registration and the effective rules of trust registration. The current practice of trust registration is mainly based on two Low-level legal documents which named "Charitable Trust Management Measures" and "Trust Registration Management Measures"．China's trust system still has many shortcomings. First of all, the law stipulates that the scope of trust registration property is not clear and the validity of trust registration does not correspond to the value proposition of the trust registration system. Secondly, the existing trust registration agencies have no explicit authorization by laws and regulations, which results in the existing trust registration in China cannot have legal effect. Finally, the existing trust product registration content cannot meet the needs of trust publicity, and the existing trust registration is not connected with the existing property ownership registration．

In view of the shortcomings of China's existing trust registration system, the improvement of China's trust registration system needs to complete the following work. Firstly, clarify the trust registration property, adopt the antagonism of trust registration. Secondly, clarify the China's trust registration agency, for unified trust registration Compared with decentralized trust registration agencies, China believes that China should choose a decentralized trust registration agency and use the existing property ownership registration agency as a trust registration agency to ensure the trustworthiness of trust registration and improve the efficiency of trust registration. Thirdly, standardize trust registration. The trust products registration is insufficiency. The content of trust registration needs to further standardize and clarify what should include both the objective status of trust property and the trust legal relationship, so as to meet the requirements of publicity. Fourthly, the trust registration process and the procedure of the existing property ownership registration are connected, including the content of application and review, in order to ensure the accuracy of trust registration, while improving the efficiency of trust registration．
