20世纪以来，化石能源的利用加快人类社会前进的步伐，使得世界经济发展日新月异。然而，燃烧化石能源所产生的无限度的碳氧化物的排放也使得全球气候持续变暖。在气候问题全球化的今天，低碳贸易壁垒作为一种新型贸易壁垒，成为发达国家对发展中国家出口的产品进行限制的重要措施。我国是世界碳排放的大国，低碳贸易壁垒的施行必然会对我国经贸发展产生不可忽视的影响。因此，如何积极应对国际低碳贸易壁垒，并借此机会，实现绿色发展道路成为我国贸易发展重要而紧迫的课题。笔者从低碳贸易壁垒的形成根源及形成背景为切入点，探析其对我国出口贸易的影响，寻找低碳贸易壁垒下我国的法律应对策略。
