行政指导作为符合现代行政发展趋势的行政方式，在行政过程中得到了越来越广泛的研究与运用，但相应的理论研究与实践立法、适用程序，都尚处于初步甚至空白的阶段，实施过程中造成的负面影响屡有发生，对于行政指导造成的利益损失之救济方式，更是缺乏应有的研究与实践，本文将尝试在探讨行政指导救济必要性、可行性的基础上，进一步探究对于行政指导有哪些可行的救济方式，以及为更有效地救济行政指导造成的损害，对现有制度、行政理念应进行哪些改进，例如对现有法律法规的扩大理解、适当增加行政诉讼的受案范围等，以求使行政指导救济制度更加完善，更加符合现代行政的发展需求。

As an administrative method according to the developing trend of modern administration, administrative guidance is being studied and used more and more widely, but the corresponding theory study, procedure of practice are still in the initial state or even blank space, there are also some negative influence in the implement process. The remedy mode to the benefit lost caused by administrative guidance also lacks of study or practice. This thesis will try to approach the feasible remedy mode to the lost caused by administrative guidance after talking about the necessity and feasibility of this remedy system, as well as the improvement to the current administrative system and idea for relieving the lost cost by administrative guidance more effectively, for example, to broaden the comprehension of the law in force, to expand the reception scope of the administrative litigation appropriately, etc., so that we can make the administrative guidance system more perfect, and be more corresponding to the demand of the development of the modern administration.
