在知识经济背景下,知识产权的重要性日益凸现。我国企事业单位越来越重视知识产权管理工作,企事业单位越来越需要知识产权管理人才。知识产权管理人才在企事业单位中在知识产权管理、科研创新、对外贸易、法律事务等方面起着专业性、导向性等作用,因其与专利代理人、知识产权律师和企业法律顾问有着人员隶属关系、工作性质和工作内容等区别,成为无法代替的企事业单位知识产权管理的核心力量。然而,本文调查表明,我国知识产权管理人才评价体系存在层次性不高、衔接性不强、权威性不足、制度不够完善等问题,使知识产权管理人才的地位、待遇与他们发挥的作用不相称,处于尴尬地位,不能完全满足企事业单位的需要。因此,亟需根据知识产权管理人才所需知识、能力水平、资格条件,建立适合其专业技术特点的职业资格制度进行评价和规范,激励他们发挥更加积极的作用。本文调查显示,大部分单位主张采用“知识产权管理工程师职业资格制度”对知识产权管理人才进行评价。研究表明,建立知识产权管理工程师职业资格制度,是我国经济发展和建设“创新型国家”宏伟战略目标的实现的需要;是我国知识产权管理人才队伍壮大、素质提升的需要;是我国企事业单位的生存与发展的需要;是人才自身职业发展、人才流动的需要。 本文采用文献调研、实地访谈和专家咨询等研究方法,并面向全国知识产权局系统及有关企事业单位发放调查问卷,初步了解了我国地方知识产权人才评价体系建设现状和需求。本文针对研究及调研情况,首先介绍了我国知识产权管理人才队伍的现状,论述了我国建立知识产权管理人才评价机制的迫切性。其次对我国现行的专利代理人、知识产权律师和企业法律顾问等相关职业资格制度进行了比较分析,进一步阐明建立我国知识产权管理工程师职业资格制度的必要性。最后在研究了日本知识产权管理工程师职业资格制度的基础上,本文提出了建立我国知识产权管理工程师职业资格制度相关建议。

With the deep development of knowledge-based economy, the intellectual property importance has become increasingly prominent, the protruding influences of the IPMP has became more and more important. The IPMP has showed the guiding, dynamic and professional role in enterprises and public institutions. As a core element in intellectual property management, The IPMP can’t be replaced by patent agents, IP lawyers or legal advisers of the important role played in the independent innovation of the enterprises. However, according to the investigations, there are several flaws in IPMP evaluation system such as low rank, awful engagement, insufficient authority and imperfect system, etc, which make the status and treatment of IPP stay in an awkard position inferior to that corresponding to the role of IPP plays, and cause the IPMP evaluation system doesn’t meet the needs of enterprises as a result.. Therefore, it’s urgent to establish a national-wide IPMP evaluation system adapt to the characteristics of the vocation with the demand of knowledge, competency and qualification of IPP, in order to encourage them playing more positive roles in their career. The paper demonstrates that, most of enterprises claim that adopt “Vocational Qualification of Intellectual Property Management Engineer” to evaluate IPP. The research shows that, the establishment of Vocational Qualification System will satisfy the demand of the national economic growth and the strategic objective of “innovative nation”, the group strength and quality advance of IPP, the survival and development of public service unit and enterprises, and the career development and mobility of talents. This paper uses several research methods, such as literature study, field research, expert consultation, and conducted a national-wide questionnaire survey on provincial patent offices, enterprises and public institutions, made a fundamental understanding of the status and needs of the local IPMP evaluation systems. According to the result, this paper introduce the present conditions of the IPMP in China, the author analyzed the growing appreciation of the need for establishing IPMP vocational qualification system. Then, the paper compared the difference of the patent agent, IP lawyer or legal adviser’s vocational qualification system, the author showed the necessity of establishing IPMP vocational qualification system. According to the study of Japan's Intellectual Property Management Engineer Professional Qualification System, the author has given some advices on establishing China’s Intellectual Property Management Engineer Vocational Qualification System.
