本文的主要写作目的是通过对1927-1937年这十年间,南京国民政府的商标立法和商标管理具体情况的考察,分析这十年间政府商标管理取得的成绩和存在的问题,探究政府在商标法制发展进步中所起的作用。  本文分四个章节。第一章介绍了南京国民政府商标管理的背景条件,包括南京国民政府之前的清政府和北洋政府的商标管理情况,南京国民政府商标管理机构的建立以及撤销广东商标机构,统一全国商标行政。第二章论述了十年间南京国民政府商标法律制定的情况,主要是1930年和1935年两次大规模的《商标法》的制定和修正。作者分别对这两次商标法的修订原因、过程以及修定前后内容的主要变化和影响进行了介绍分析,并深层分析了这些变化产生的根本原因——是在社会力量推动下政府为维护其统治被动所为。第三章主要阐述了十年间南京国民政府商标管理的基本情况。介绍了政府商标行政的基本概况;探讨了政府商标管理的成效,通过对十年间中外注册商标数量的分析,得出结论:这十年间南京国民政府的商标管理是取得了一定的积极成效的;探究了取得这些积极成效的原因并指出了政府商标管理中存在的不足。最后一章,在叙述了南京国民政府商标纠纷的处理程序及相应处理官署后,重点介绍了商标争议纠纷中的华洋商标之争。华洋商之间的商标之争,不仅仅只是普通的商事纠纷,还带有强烈的政治色彩。作者通过对典型案例的剖析,揭示了华洋商商标争议背后的实质——各国列强为了维护他们在华的侵略利益,以商标诉讼为手段,对中国的民族工商业进行打击压制。在这过程中,南京国民政府有时充当了帮凶的角色。
外文摘要:
The main purpose of this article is to analyze the achievements and the existing problems on the governmental trademark management in the ten years and probe into the functions the government had .in the development of the trademark legislation, by researching the concrete conditions of the trademark legislation and management of Nangjing National Government during the ten years from 1927 to 1937.  This article can be divided into four chapters. Chapter One introduces the background information about trademark management of Nanjing National Government, including the trademark management in Qing dynasty and Northern warlords government, the construction of trademark management institution and the repeal Guangdong trademark institution, the unification of the country trademark administration. Chapter Two discusses something about the establishment of the trademark legislation by Nanjing National government in this ten years, mainly two large-scale establishment and revise of “Trademark Act” in 1930 and 1935. The author introduces the reasons, process, the changes of the content and influence about this two revise of “Trademark Act”, and analyzes the basic reasons that causes the changes------the government did it to maintain its rule under the drive of social power. Chapter Three chiefly expatiates on the basic condition about the trademark management in the ten years. It introduces the general situation on the government trademark administration; explores the effect of the government trademark management and by analyzing the number of trademarks registered by Chinese and foreign companies in that ten years draws the conclusion: Nanjing National Government’s management of trademark is successful to some extent in the ten years; probes into the reasons that makes good and points out the existing defaults. Chapter Four focuses on the trademark competition between china and foreign countries in the trademark dissension after it narrates the process and corresponding offices that deals with the trademark dissension. The trademark competition between Chinese and foreign countries is not only ordinary commercial dispute, but also political. The author reveals the essence behind the trademark dissension between china and foreign countries through anatomizing typical cases each imperialist for their own invasive profit in china took the means of trademark lawsuit and tried to strike and suppress china national industry and commerce. During this process, Nanjing National Government sometimes acted as a accessory.
