在知识经济时代，中国面临着经济全球化的挑战，国际竞争日益激烈。专利法的国际协调也在不断的进展中，越来越多的企业积极参与专利的海外布局和竞争。然而，我国专利事业起步晚，相关经验极度匮乏，在海外专利竞争中面临巨大的专利风险，严重打击了企业的发展以及创新的积极性，深刻影响了它们的国际竞争力。要提高企业的国际竞争力，必不可少地需要专利政策的协助。本文的创新之处在于，从提升企业国际竞争力的视角，采用理论与实践相结合的方法,通过运用公共管理和公共政策相关理论，以及比较研究法、规范研究法、系统分析法和文献分析法来深入分析了影响我国企业国际竞争力的核心专利政策，并分类梳理出政策框架。同时笔者深入调研了数家典型企业，从企业的角度分析政策的不足并分析了原因。本文还有针对性介绍了数个发达国家为了提升本国企业国际竞争力的专利政策以及其启示，最后笔者试图运用公共政策相关理论，结合我国的现状运用SWOT分析方法深度分析当前的优势和劣势，试图提出有针对性能提高我国企业国际竞争力的专利政策提出改进建议。

At present, all mankinds are entering the era of knowledge economy, and China is also facing with economic globalization, the challenge of international competition is becoming increasingly fierce. More and more homegrown enterprises actively participate in the overseas patent arrangement and competition. However, China's patent career started late and extremely lacked of relevant experience, the enterprises are facing huge patent risk, which result in a serious blow to the development of enterprises, the incentive to innovate, and their international competitiveness. To improve the international competitiveness of enterprises, we need the assistance of patent policy. This paper in-depth analyses the disadvantage of existing patent policy that affect the international competitiveness of enterprises and tries to classify the policy to tease out the policy framework by applying the theories of the public management, public policy, methodology of comprehensive use of theoretical analysis and empirical analysis, the combination of comparative and systematic analysis, normative analysis, and document analysis. The author also investigated several typical enterprises, analyzed the lack of the policy from the view of enterprises and analyzed the reasons. This article has targeted a number of developed countries in order to learn from their patent policy which enhances the international competitiveness of domestic enterprises. Finally, the author attempts to use public policy theory, the SWOT analysis method which analyzed the strengths and weaknesses of the current situation, combined with the status quo of China to try to put forward suggestions for improvement for the feasibility of policy performance to improve the international competitiveness of enterprises in China, the suggestions are divided into two types: to enhance the quality and efficiency of innovation and the creation of good patent environment.
