现代社会,必须强调尊重人格,维护人的基本权利,这是构建和谐社会的必然要求。隐私权则是人的基本权利之一。隐私权并不仅仅属于成年人,未成年学生也一样应有自己的隐私权。根据对湖南省、新疆维吾尔自治区两地七所学校的问卷调查和访谈,发现我国未成年学生隐私权保护现状不容乐观,侵犯未成年学生隐私权的现象比较普遍,存在未成年学生隐私权与父母或者其他监护人、学校及其教师的知情权、管教权冲突的困惑。出现这一现象的主要原因在于:一是由于未成年学生隐私权的特殊性,容易与父母或者其他监护人的亲权、监护权以及学校教师的知情权、管教权出现冲突;二是未成年学生是一个弱势群体,他们的隐私权更容易受到侵害;三是由于我国关于未成年学生隐私权保护的立法薄弱,权责不明;四是父母或者其他监护人、教师的法律素质和意识较差。美国是把隐私权作为一项独立的人格权,采取直接保护方式。而我国对于未成年学生隐私权的立法保护内容零散,缺乏系统的衔接与统一的表述,还没有把隐私权作为一项独立的人格权,对隐私权的保护采取的是一种间接保护方式。所以相对于法制较为健全的国家来说,我国对于未成年学生隐私权的立法保护还相对落后。未成年学生隐私权具有特殊性,因为他们是无行为能力人或限制行为能力人,受到年龄、智力和能力的影响,其隐私权也必然会受到来自监护人、学校和教师权力的限制。未成年学生的隐私权具有有限支配性。未成年学生在学校接受教育,法律规定学校有权对学生进行教育、管理和奖惩。因此,未成年学生的隐私权一般要让位于学校的知情权和教育管理权。当然,学校同时对其有保密的义务。在此基础上,提出了未成年学生隐私权的“边界”的新概念。基于未成年学生隐私权与父母或者其他监护人、学校教师的知情权、管教权容易出现冲突,我们应该运用权利协调原则、利益衡量原则、以人为本的原则等来协调未成年学生隐私权的“边界”冲突,找到合理的交叉点,既不侵害未成年学生的隐私权,又能够因材施教,很好地教育管理学生。本文通过问卷调查法、访谈法和文献法,对我国未成年学生隐私权现状的调查以及国内外隐私权保护立法现状的比较分析,发现我国未成年学生的隐私权往往容易受到侵害,在实践中不乏其例。在我国隐私权立法保护方面也还存在许多问题和空白。针对未成年学生隐私权的“边界”问题,提出了我国未成年学生隐私权保护的具体措施及立法建议。在立法当中,把隐私权作为一项独立的人格权;制定关于隐私权保护的单行特别法;制定和完善配套的法律法规来保护未成年学生的隐私权。

In modern society, we should respect the human personalities, support the basic human right, which are inevitable requests for the construction of the harmonious society.Privacy right is one of the basic rights to people.It does not only belong to adults,but also the minor students.Through questionnaire survey and interview with seven schools in Hunan and Xinjiang,this paper finds that people can not be optimistic about status quo of the protection of the minor students’ privacy, the offences on the minor students’ privacy are widespread.The main reasons for this phenomenon are as follows: Firstly,because of the particularity of the minor students’privacy,it may conflict with parents and other guardians relative right Parental rights,wardship right,and school teachers’ knowing right,managing and instructing right.Secondly, minor students belong to inferior groups,and their mental enduring ablities are weak,so their privacy right is easyly violated.Thirdly, legislation for protection of minor students’privacy is weak,and the rights; obligations on it are not clear enough. Fourthly,leagl consciousness of parents and other guardians and teachers are not very good. In United States,privacy right is regarded as an independent personality right,and the way of protection is direct. However,in our country,the content of the privacy protection of minor students’ is loose, lacking of systematic connections and consolidated expression;and we don’t view privacy right as an independent personality right,we just take indirect actions to protect it.So,in contrast to the countries with sound legal system,legislation protection of minor students’ privacy in our country lags behind relatively. Minor students’ privacy is of particularity, Beacuse that they are persons with no contractual capacity and limit contractual capacity,who are affected by age,intellect,and abilities,their right of privacy must be inevitably limited by the power from guardians,schools and teachers.Minor students’right of privacy are controled with limitation by themselves.Minor students study in schools, and the law prescribed that schools have rights to instruct,to manage,to reward and punish.So,minor students’ right of pivacy should give place to schools’ right of instruction and supervision.In the same time ,schools should be obliged to keep secret from which we put forward the new conception of boundary about minor students’ privacy.Owing to the conflict between underage students’ privacy and parents and other guardians and school teachers’right on knowing ,instructing and managing. Through right-harmonizing principle, benefit-measuring and human-oriented,we can harmonize the comflit of the boundary about minor students’ pricacy. On the one hand ,we won’t intrude privacy right of minor students; on the other hand, we can teach students in accordance of their aptitude, manage and instruct them very well. After investigation about status quo of minor students’ privacy in our country and compares between domestic and overseas legislation protection of privacy right by questionare survey,interview,and literature analysis,this paper finds that in primary and secondary schools, minor students’ privacy is easy to be inroaded,which is prevalent;In our country,there are still problems and vacacies in the legislation for the protection of privacy right.This paper puts forward to concrete measures for the protection of minor students’ privacy and the corresponding legislative suggestions.In process of making laws, we can regard privacy as an independent personality right, setting up the single special law about protecting privacy and improving acts to protect the minor students’ privacy.
