行政法的核心在于裁量,而行使自由裁量权的重要依据包含裁量基准。合理地行使自由裁量权不仅有利于法律更好地贯彻实施,还有利于法律法规更容易地被社会所理解和接纳。但是,行政执法实践中滥用自由裁量权的情况时有发生,这不仅会使行政相对人的合法利益受到损害,还会激发民众的误解和对行政执法行为的不满情绪,长此以往,势必影响社会的稳定和发展。行政部门在执法的过程中,为了进行自我约束,提高执法水平,就制定了裁量基准来规制自由裁量权的使用。通过裁量基准,行政机关知晓自己执法的范围和限度所在,一定程度上做到了合法与合理行政。裁量基准越来越广泛的应用,也引发了大批的专家和学者进行研究和探讨,毕竟一个成熟的制度需要做大量的实践与花费很长的时间去验证和完善。目前,我国的裁量基准确实存在很多的不足和有待改进之处,所以,对此进行研究还是颇具现实意义的。经过搜集资料发现,我国很多学者的研究方向多是从行政裁量基准这个大概念出发进行研究的,几乎没有单独研究某一领域某一类型的裁量基准的,这对我们的研究提供了一个思路和方向。近年来,由于我国食品安全问题多发,国家对于食品安全问题也越来越重视,各省的食品安全行政处罚裁量基准也陆续被制定并日益完善。所以笔者意在研究食品安全行政处罚裁量基准,梳理我国食品领域裁量基准的概念和构成要素,整理其现状并发现其存在的问题,并提出改善途径和方法,以便能为行政实践提供一些参考。
本文共分为四部分。第一部分讲述了我国食品安全行政处罚裁量基准的概念和构成要素,分析其内涵、性质和构成要素;第二部分讲述了我国食品安全行政处罚裁量基准法律依据;第三部分讲述了我国食品安全行政处罚裁量基准的现状和问题,如构成要素不同、制定程序不完善、内容前后矛盾等;第四部分是通过提出建议来完善食品安全行政处罚裁量基准,着重从制定原则、制定程序、评估机制等几个方面出发解决现有的问题。

The core of administrative law lies in the discretion, and the important basis of exercising the discretion is to include the discretion benchmark. The reasonable exercise of discretionary power is not only conducive to better implementation of the law, but also conducive to the understanding and acceptance of laws and regulations. However, the abuse of discretionary power in the practice of administrative law enforcement often occurs, which not only damages the interests of the administrative counterpart, but also stimulates the public's misunderstanding and antagonism. The development of administrative penalty discretion is a useful measure to restrict the administrative organs and regulate the discretionary power. The more and more extensive application of the discretion benchmark has led to the research and discussion of a large number of experts and scholars. The author found after collecting data, many scholars in our country from administrative discretion benchmark research direction and the study of the great concept, almost no separate a field of a certain type of discretion benchmark. In recent years, due to the issue of food safety in China, the state has paid more and more attention to the food safety issue, and the administrative penalty discretion benchmark in the food field has been developed. So I just want to study food safety discretion benchmark of administrative penalty as the beginning, analyze the present situation of the food in our country administrative penalty discretion benchmark, in order to find the existing problems, and put forward improving ways and methods, so as to provide some reference for the administrative practice.
This paper is divided into four parts. The first part describes the concept and constitution elements of China's food administrative penalty, and analyzes the connotation and constitutive elements of the food administrative penalty. The second part describes the laws and regulations related to food administrative penalty in China. The third part describes the present situation and the problem of the administrative penalty of food safety administration. The fourth part is about the improvement of China's food administrative penalty benchmark, focusing on the formulation of the principle of formulating the procedure evaluation mechanism to solve the existing problems and deficiencies.
