关于患者知情同意权问题的研究摘　要随着人们权利意识的逐渐增强以及医疗科技的发展，患者的知情同意权越来越受到人们的重视，尤其是近几年医患矛盾不断升级使得人们对于建立科学完善的知情同意权制度的呼声更加强烈。知情同意权，最基本的理解就是在知的基础上的同意，在此基础上做出了医疗决定才是患者真正的意思表示。然而由于医疗信息逐渐专业化，导致了医患双方的信息越来越不对等，这样的话就算患者做出了某种医疗决定，但也绝不是知情同意权所倡导的模式。医疗行为多涉及到患者的身体权，甚至生命权，而这恰恰属于私人自治的范畴，患者对此有完全的自主决定权，而且任何一个意识健全的人都可以要求独立行使该项权利。因此，尊重患者的知情同意权不仅是对患者的负责，更是对患者人格尊严的一种尊重。本文共分为五个部分。第一部分主要介绍知情同意权的产生以及国内外有关知情同意权的规定，学习先进的理论，为我国知情同意权制度的完善提供借鉴。第二部分主要介绍知情同意权的性质、特征及其存在基础。知情同意权实质上是两种权利的结合，各自都有自己的内容，在这个部分笔者着重介绍了知情同意权存在的法理基础以及法律价值基础。第三部分主要说明在医疗过程中如何实现患者的知情同意权的问题，医疗情况复杂多变，怎样才能保障知情同意权制度能得到有效的贯彻落实是十分重要的，在这个部分，笔者主要以列举方式阐明了知情同意权的主要内容以及如何实现等问题。第四部分主要阐述的是知情同意权的例外即紧急专断治疗的一些问题，作为一种例外情况，紧急专断治疗自然具备严格的条件，笔者以此为基础阐述了如何更好的保护患者的权益。第五部分是笔者对当下知情同意权制度的完善提出的一些建议，主要从制度以及实施方面阐明了自己的一些拙见。和谐的医患关系需要大家的努力，但前提是制度的完善，以此建立科学合理完善的患者知情同意权制度刻不容缓。关键词：知情同意权，医患关系，紧急专断治疗，告知义务

Research on Patients Informed Consent Right ProblemABSTRACTAs people rights consciousness gradually strengthened, and the development of medical technology, patients informed consent right of more and more get people's attention, especially in recent years the doctor-patient conflicts escalating makes people to set up scientific calls to improve the system of right of informed consent. Informed consent, the most basic understanding is on the basis of the known permission, on the basis of the real intention to make medical decisions is patients. However due to the specialization of medical information gradually, thus cause the doctor-patient information of both sides more and more unequal, so even if the patient has made some medical decisions, but also is no informed consent rights advocated by model. Medical practice involves the patient's body weight, even the right to life, and it just belongs to the category of private autonomy, patients have full self-determination, and any people who is a consciousness may require the independent exercise of the rights. Therefore, respect for patients right of informed consent is not only responsible for the patients, but also a kind of respect of patients personality dignity. This article is divided into five parts. The first part mainly introduces the generation of informed consent and relevant regulation about the right of informed consent, at home and abroad to learn advanced theory, for the improvement of the system of right of informed consent. The second part mainly introduces the nature of the right of informed consent, characteristics and existing basis. The combination of the right of informed consent in liang kind of right, each have their own content, in this part the author introduces the informed consent right of existing legal basis and legal value basis. The third part mainly shows how to implement in the process of medical informed consent right of patients, medical condition is complicated, what is guarantee patients informed consent right system can get effective implementation is very important, in this part, the author mainly enumerated way to illustrate the main content of the right of informed consent and how to implement and so on. The fourth part mainly expounds the right of informed consent exception is that some problems of emergency treatment of arbitrary, as one of the exceptions, emergency treatment of arbitrary nature have strict conditions, the author elaborated based on how to better protect the rights and interests of patients. The fifth part is the author of the present Suggestions of improvement of the system of right of informed consent, mainly from the system and illustrates the implementation of some of his own humble opinion.
