认罪认罚从宽制度是我国进入社会主义新时代为落实宽严相济刑事政策、促进司法资源合理配置而出台的重要制度。在注重被追诉人权利保护的大背景下,被害人因其在认罪认罚案件中的弱势地位引起了学界的热议;与此同时,实践中被害人在认罪认罚案件中的参与出现了参与不足、权利滥用等问题。完善被害人在认罪认罚案件中的参与,对于促进认罪认罚从宽制度良性运行、建立公平公正的刑事司法体系具有重要意义。 本文重点关注认罪认罚案件中被害人的参与权利在司法实践中的运行状况,采用实证分析的方法从大量案例数据中提炼实践中的问题,从而提出针对性完善措施,以期保障被害人在认罪认罚案件中的参与权利。 除绪论和结语外,本文共分为四个章节展开研究。 第一章对认罪认罚案件中被害人的参与进行学理阐释。主要包括两个方面:一是解释被害人的定义,明确被害人享有的权利,为后文探究程序从简对被害人参与权利的影响奠定基础;二是探究认罪认罚案件中被害人参与诉讼的价值,这些独特的价值是认罪认罚案件中被害人参与的重要原因。 第二章为认罪认罚案件中被害人参与诉讼的现状及问题检视。以实证分析的方式呈现了实践中认罪认罚案件被害人参与的现状,通过分析案例数据总结认罪认罚案件中被害人参与的问题,即认罪认罚程序简化影响被害人参与、被害人谅解的标准不一、被害人参与对量刑的影响不规范。为后续制定对策提供数据支撑。 第三章为认罪认罚案件中被害人诉讼参与的理论依据。从理论角度探究认罪认罚案件中的被害人参与,分别从诉讼构造理论、协商性司法理念和恢复性司法理念出发,探究被害人在认罪认罚从宽制度中所处的地位以及其诉讼参与的理论依据。 第四章为认罪认罚案件中被害人参与的优化路径。首先明确认罪认罚从宽制度中的底线权利并进一步细化,并完善相应的权利救济体系;其次针对被害人参与的重要方式即刑事谅解书提出规制手段;最后针对不同案件类型被害人的参与设计对量刑的影响体系,以期更好保障认罪认罚案件中被害人的参与权。

The leniency system for confession and punishment is an important system introduced by China in the new socialist era to implement the criminal policy of combining leniency with severity and promote the rational allocation of judicial resources. Against the backdrop of emphasizing the protection of the rights of the accused, the victim's weak position in confession and punishment cases has sparked heated discussions in the academic community; At the same time, in practice, the participation of victims in cases of confession and punishment has also encountered issues such as insufficient participation and abuse of rights. Improving the participation of victims in cases of confession and punishment is of great significance for promoting the healthy operation of the leniency system for confession and punishment, and establishing a fair and just criminal justice system. This article focuses on the operational status of the victim's right to participate in cases of confession and punishment in judicial practice. Empirical analysis is used to extract practical issues from a large amount of case data, and targeted improvement measures are proposed to safeguard the victim's right to participate in cases of confession and punishment. In addition to the introduction and conclusion, this article is divided into four chapters for research. The first chapter provides a theoretical explanation of the participation of victims in cases of confession and punishment. It mainly includes two aspects: one is to explain the definition of victims, clarify the rights enjoyed by victims, and lay the foundation for exploring the impact of simplified procedures on victims' participation rights in the following text; The second is to explore the value of victim participation in litigation in cases of confession and punishment, as these unique values are important reasons for victim participation in cases of confession and punishment. Chapter 2 examines the current situation and issues of victim participation in litigation in cases of confession and punishment. This article presents the current situation of victim participation in cases of confession and punishment in practice through empirical analysis. Through analyzing case data, it summarizes the issues of victim participation in cases of confession and punishment, namely, the simplification of confession and punishment procedures affects victim participation, the standards for victim understanding are different, and the impact of victim participation on sentencing is not standardized. Provide data support for the subsequent formulation of countermeasures. Chapter 3 is the theoretical basis for the participation of victims in litigation in cases of confession and punishment. Exploring the participation of victims in cases of confession and punishment from a theoretical perspective, starting from the theory of litigation structure, the concept of negotiated justice, and the concept of restorative justice, explores the position of victims in the leniency system of confession and punishment, as well as the theoretical basis for their participation in litigation. Chapter 4 is the optimization path for victim participation in cases of confession and punishment. Firstly, clarify the bottom line rights in the leniency system for confession and punishment, and further refine them, and improve the corresponding rights relief system; Secondly, propose regulatory measures for the important way for victims to participate, namely the criminal memorandum of understanding; Finally, design an impact system on sentencing based on the participation of victims of different types of cases, in order to better safeguard the right of victims to participate in cases of confession and punishment.
