近年来,得益于互联网技术、移动支付等数字信息技术的广泛应用,我国平台经济飞速发展。在线劳动平台企业在促进就业数量增长的同时,也催生了大量的新职业、新岗位,如网约配送员、网约车司机等,衍生出了以平台、商家、劳动者的三方服务方式,出现了不完全符合确立劳动关系情形的用工形式。特别是新冠疫情期间,在线劳动平台企业有效地吸纳了新增的、摩擦性失业和制造业流出的就业人口,发挥了就业“蓄水池”“稳定器”功能。新就业形态劳动者如快递员、网约车司机、网约配送员等职业的出现与兴起,对拓宽就业新渠道、培育新动能起了重要作用,推动了经济高质量发展。新就业形态劳动者群体也成为了我国灵活就业人群的重要组成部分,其劳动关系呈现出用工多元化、灵活化、自由度高、系统连接度强、属地及用工时长分散化等特点。而网约配送员属于城市管理的末梢,承担着城市及群众生活服务的重要一环。但平台企业与劳动者的纠纷、忽视劳动者权益的事件时有发生,平台企业规避用工模式,逃避用工责任,利用算法控制骑手,从而导致劳动者的身心健康受到损害,影响了平台企业的经济发展和声誉塑造。由于新就业形态劳动者数量之庞大,损害其利益更会严重影响着社会的和谐与稳定。新就业形态的发展给政府监管带来了机遇与挑战,绝大部分的新就业形态劳动者无法享受与传统劳动者相同的劳动权益保障,出现了劳动力市场两级分化的现象。政府监管缺失将影响着社会的公平,不利于社会的和谐稳定,不利于平台经济的健康发展。为更好地发挥新就业形态作用,要落实好政府监管作用,兼顾好平台企业与劳动者的利益平衡点,才能进一步发展平台经济,最终确保社会稳定与发展。 本文以美团外卖平台为例,通过研究分析美团外卖履行外卖骑手用工责任及政府对企业用工责任监管的现状,探讨政府对美团外卖乃至互联网在线劳动平台企业的监管措施,探索如何最大限度地保障新就业形态劳动者劳动权益。首先通过梳理相关文献,厘清在线劳动平台企业用工责任的界定,再通过访谈法和问卷调查法了解骑手日常工作情况,了解目前政府对平台企业用工责任的监管情况与措施,从而发现美团外卖落实用工责任方面的不足之处。根据调查,骑手普遍存在工作强度大、工作时间长、劳动安全保障低等劳动权益受损问题,影响着劳动者的身心健康,影响着社会的和谐稳定,影响着平台经济的发展,而由于在线劳动平台经济和用工方式属于新兴产物,政府监管存在滞后性。调查发现,政府监管存在理念落后、监管能力不足、政府监管体系不完善、基层政府间沟通合作不畅、监管合力不全等问题。因此,亟需政府调整监管理念,完善监管体系,加强对平台企业的监督管理。针对上述监管问题,本文提出完善政策监管体系、提升政府监管能力、完善政府服务制度等三项监管措施,从而促进平台企业的可持续性、健康发展,保障新就业形态劳动者的合法权益,推动平台经济高质量发展。 |

In recent years, benefit by the wide application of Internet technology, mobile payment andother digital information technology, Chinese platform economy has developed rapidly. Whilepromoting the growth of employment, online labor platform enterprises have also given birth to alarge number of new occupations and new jobs, such as online dispatchers and ride-hailing drivers,which have been derived from the tripartite service of platforms, businessmen and laborer’s. Therehas been a form of employment that is not entirely in line with the establishment of labor relations.Especially during the COVID-19 epidemic, the online labor platform enterprises effectivelyabsorbed the new employment, frictional unemployment and manufacturing outflow, and playedthe function of employment "reservoir" and "stabilizer". The emergence and rise of newemployment forms of workers, such as couriers, ride-hailing drivers and online contractdistributors, play an important role in broadening new channels of employment, cultivating newmomentum and promoting high-quality economic and social development. The labor group of thenew employment form has also become an important part of the flexible employment populationin our country, and its labor relations show the characteristics of diversified employment, flexibility,high degree of freedom, strong system connectivity, decentralization of territorial and workinghours, and so on. The network dispatcher belongs to the end of urban management and undertakesan important part of the life service of the city and the masses. However, disputes between platformenterprises and workers and neglect of workers' rights and interests occur from time to time.Platform enterprises evade the employment mode, evade employment responsibilities, and usealgorithms to control riders, resulting in damage to the physical and mental health of labourers. Itaffects the economic development and reputation shaping of platform enterprises. Due to the largenumber of workers in the new employment form, harming their interests will seriously affect theharmony and stability of the society. The development of the new employment form has broughtopportunities and challenges to the government supervision. Most of the workers in the newemployment form can not get the same protection of labor rights and interests as the traditional workers, and the phenomenon of two-level division of the labor market is becoming more andmore obvious. The lack of supervision in the government is obviously not conducive to socialfairness and stability, and to the healthy development of the platform economy. In order to givefull play to the role of the new employment form, it is necessary to implement the role ofgovernment supervision and balance the interests of platform enterprises and workers in order tofurther develop the platform economy and ultimately ensure social stability and development. Taking Meituan as an example, this paper studies and analyzes the current situation thatMeituan fulfills the employment responsibility of takeout riders and the government supervisesthe employment responsibility of enterprises, and discusses the government's supervisionmeasures on Meituan and even Internet online labor platform enterprises. To explore how to betterprotect the labor rights and interests of workers in the new employment form. First of all, bycombing the relevant literature, clarify the definition of employment responsibility of online laborplatform enterprises, and then through interviews and questionnaires to understand the daily workof riders, to understand the current government supervision and measures of employmentresponsibility of platform enterprises, so as to find out the deficiencies in the implementation ofemployment responsibility of Meituan. According to the survey, riders generally have the problemsof damaged labor rights and interests, such as high work intensity, long working hours and lowlabor security, which affect the physical and mental health of workers, the harmony and stabilityof society, and the development of platform economy. As the economy and employment mode ofonline labor platform are emerging products, government supervision lags behind. The surveyfound that there are some problems in government supervision, such as backward concept, lack ofsupervision ability, imperfect government supervision system, poor communication andcooperation between grass-roots governments, incomplete supervision and so on. Therefore, thereis an urgent need for the government to adjust the concept of supervision, improve the supervisionsystem, and strengthen the supervision and management of platform enterprises. In view of theabove regulatory problems, this paper proposes three regulatory measures to improve the policyregulatory system, enhance the government regulatory capacity, and improve the governmentservice system, so as to promote the sustainable and healthy development of platform enterprises,protect the legitimate rights and interests of workers in new forms of employment, and promotethe high-quality development of platform economy. |
