近年来，社会的急剧变迁和改革的深化，使得高校面临的外部环境变得日益复杂；社会转型和高等教育改革的交织，使得高校在发展中面对了更多不确定的因素，各种突发事件不断发生；我国高等教育大众化进程的不断深入，使得高校成为人群高度聚集的地方，突发事件发生的频率、规模、复杂度都呈上升趋势。高校发生突发事件后，为了维护校园的秩序和安全、减少人员伤亡和财产的损失，各高校及教育行政部门均会采取相应的应急措施，这势必会限制学生的某些权利。合法、合理的限制是正当的，也是必要的，然而我国法律对这一限制的前提、手段、条件、程序等缺乏明确的、可操作性的规定。现实中许多高校及行政部门采取的应急措施违反了“以人为本”原则、比例原则，侵犯了高校学生的合法权益，给学生的身心健康造成了极大的伤害。突发事件中如何在学生权利的保障与限制的相对紧张关系中求得适度的平衡，这是我们应该考虑的问题。本文第一部分大体的介绍了高校突发事件，对高校突发事件的概念、界定范围、特征及我国当前高校突发事件的现状都做了说明，以期对高校突发事件有个整体的了解。第二部分，首先分析高校突发事件对学生权利的影响，主要包括生命健康权、人身自由、言论自由、隐私权、知情权五项权利，这五项权利往往也是在高校突发事件中学生容易受到侵害的权利；其次，结合实际事例分析我国现行高校突发事件中学生权利保障存在的缺陷，如应急措施背离“以人为本”的原则，应急措施违背比例原则，突发事件中信息反馈机制缺失，应急预案中缺乏对学生权利的明确规定，现行法律缺乏对学生不可克减权利的规定，高校学生权利救济渠道不健全等。第三部分介绍了发达国家美国和日本在应对校园危机时保障学生权利方面值得我们借鉴的经验：如校园安全立法完善、注重学生安全教育、校园警察服务意识高、引进社会保险制度等方面的措施。第四部分针对我国在突发事件中高校在保障学生权利方面存在的问题，提出了一些适合我国国情的可行性措施：如完善校园安全立法，编制专项应急预案，加强对应急预案的演练，公开突发事件的相关信息，完善我国高校学生权利法律救济机制。

With the rapid change of the society and the deepening of the reform, the external environment faced by the colleges becomes more and more complicated; the interlacing of the social transition and the reform of the higher education imposes a great number of uncertain elements on the development of the colleges, as a consequence, different sorts of emergencies keep happening; Besides, with the advancing of the mass higher education, the college becomes the place that is highly crowed, thus the frequency, the scale and the complexity of the emergencies all show a trend of escalation. After the occurrence of the emergencies, to maintain the order and security of the college and to decrease casualty and property losing, the colleges and the administrative departments of the education will take emergency measures so that the normal study order and school life could be soon retained, however, these measure will inevitably restrict some right of the students. The legal and reasonable restriction is justified as well as necessary, however, the law in China is not clarified about the premise, approach, condition, procedure of this restriction. As a result, the emergency measures taken by many colleges and the administrative department go against the principle of “human-orientation”, the principle of proportionality ，which violates the basic right of the college students and does a lot of harm to the college students’ physical and mental health. Then, how can we reach the appropriate balance between the guarantee of the student’s right and the restraint of the student’s right? This is the question that we should concern about.The first part generally introduces what are the college emergent events, talk about the conception, range, features, current situation of the college emergent events. The second part firstly from life and health, personal freedom, privacy, freedom of speech, and the right to know five aspects to introduce the impact of the emergency in the college has upon the student’s right. Secondly, combining with actual small cases to analysis the flaw on the protection of students’ rights in the college emergent events in our country, such as departure from the "people-oriented" principle, information feedback loss, against proportion principle, lack of the rule on students who are not reduction rights, lack of supervision on the college emergency management, the system of students ’rights relief is unsound. The third part introduce the valid measures taken by the developed countries such as America, Britain and Japan to protect the student’s right when the emergency takes place in the college, such as the college safety legislation, pay attention to students’ safety education, high service consciousness of college police, introducing the social insurance system into college. The fourth part comes up with feasible measures suitable for China by studying the existing problems in the protection of the student’s right in the emergency, such as perfecting the campus safety legislation, formulating emergency plan, drilling emergency plan, opening the information about emergent events and perfecting the system of students' rights relief.
